aaron hernandez did not murder his friend. >> reporter: susan candiotti, cnn, fall river, massachusetts. >> now, naturally attorneys on both sides painted very different pictures of aaron hernandez during opening statements. earlier i spoke with defense attorney mark geragos. he feels there are some significant factors that could help hernandez. >> well i will tell you, what was originally about a month or six weeks ago thought to be a slam dunk prosecution case does not appear to be today. there's several reasons for that. number one, the judge has excluded any mention or use by the prosecution of the other two murders he's charged with. and number two, there was a text message from the deceased which he said i'm with nfl, presumably referring to nfl. that's been excluded as well. given that and i think most significantly the fact that he's not being tried, this trial does not have the other two gentlemen who are charged with murder there in the courtroom with him, i think that given the jury makeup he's got a fighting chance in this case and i like the jury makeup from a defense stand

our susan candiotti inside the courtroom learned one of the first witnesses to be called will be odinyd's mother who is in the courtroom right now. >> very interesting. even before the opening statements begin, mel, the defense has had some pretty sizable victories here. the defense didn't want certain text messages they won on that. the defense didn't want the jury to know that aaron hernandez is charged in a separate set of murders. they won't learn about that. how is it going to affect this trial assist begins right now? >> good morning, everybody. john an excellent question. tt a huge setback to the prosecution that the judge has said number one, you cannot introduce text messages. why would they want to introduce the text messages? because the text messages from odin lloyd right before he was killed execution style to his sister about who he was with it just said nfl. so the presumption would have been that had they been able to introduce that they would have been able to argue to the jury that oh did lloyd's state of mind was that he was in fear and that he wanted his sister to

. >> our susan candiotti has been following the story. we hear the father talking there. how on earth did a mamma's boy like this kid from ohio a 20-year-old, no ties to islam, caucasian kid from the midwest, how did he get tied up in there and how did the fbi get onto his trail? >> certainly what his family is asking those are many of the same questions. apparently the biggest mistake this young man made was going on twitter, using social media and making comments allegedly in support of isis of isil posting videos and comments about that on twitter. now, at some point we learned from the fbi that a confidential informant gets involved. this is someone who does haven't a clean slate. he's in trouble with the law. it appears, according to these documents that he tries to cut a deal for himself or is cooperating in hopes of helping his own situation. in any case the fbi brings him in. the two men exchange messages online. there are actually two meetings. and during the course of this cornell writes according to the criminal complaint, quote, we should meet up and make our
