this after months of treatment and evaluations and 9 news reporter tarhonda thomas is here with more and he has been through this process before. >> yes, he has, corey. the latest competency evaluation for robert dear. he had one to finish up in may which has delayed his trial. and that is because at the time admitted shooter was unfit it to stand trial but the judge wanted to come back in a few months, and re-evaluate the defendant, after receiving mental treatment. that's where today's hearing comes into play. we will find out if he is still unfit to stand trial, or if he is being competent. lots of court outbursts during the trial. and three people died in the attack on the colorado springs planned parenthood last november. the shooter waged the attack in opposite to abortions. a forensic previously determined that the defendant had to receive treatment before the trial could continue. and they will look at the competence hearing and find out where the trial goes from here. >> thanks, tarhonda. >>> when you dial the numbers 911, you know the person on the other end is there to hel

tarhonda- the plaintiffs-- say the city kicked them out for more housing developments... a suspect is dead officers were responding to a domestic disturbance near college avenue and vine.... when they arrived to see a suspect illegally entering a woman's home. the suspect left the home with a weapon in his hand... police tased him but they shot him. no officers were hurt. a colorado mom gave her life- to save her two year old son. chelsea russell of lakewood died in lake powell in the southeast corner of utah. her toddler fell off a moving house boat. mom jumped in after him- but neither had a life vest. another family member got in a smaller boat to help the pair. the child was alive and awake - and on his mother's chest. russell was unconscious. they tried c-p-r - but could not revive her. a woman in aurora is dead- and everyone who was inside the apartment with her is under arrest. it's unclear how many people that is- or really what happened at all. the woman died in an apartment on east ohio place last night. police say there's no danger to anyone else. this morning-

gary and tarhonda here with you this morning. marty's here too -- it's nice now, but it's going to get pretty warm out there today... delta airlines plans flights today.. they're still recovering from a power outage in atlanta that crashed their computer system. thousands of passengers were stranded. today - the power company involved says-- it was delta's equipment - not theirs - that caused the outage. delta says they will continue to offer refunds and vouchers to passengers who are affected. former illinois governor rod blagojevich will be back in federal court this morning. he's currently serving a 14 year sentance in a colorado prison for corruption charges -- including trying to sell president a' llinois. blagojevich has served four years already. he will be resentenced today because some of the original charges were thrown out after an appeal. three girls died after drowning in a swimming pool in pueblo. two of the girls were sisters. the third-- was their babysitter. the girls were swimming at a mobile home park in pueblo

tarhonda thomas will be at bear tips -- coming up at 5. and back to school -- means back to homework. kids are getting more and more tech savvy these days -- even when it comes to studying. there's a big market for apps that help with penmanship, math, and science skills. and many students are all over it... cut to teachers use an app called "canvas" - where they post homework and extra study materials. back in june -- toxic chemicals contaminated the drinking water in three southern colorado cities. now - colorado health officials say it's "highly likely" that those chemicals came from fef foam - used at peterson air force base. the chemicals in question don't break down - so boiling the water doesn't do anything. residents in security, widefield and fountain -- all in el paso county - have laregly switched to bottled water. water filters and ground water are also being used. officials have not ruled out additional chemicals, but say the foam - often used in air force training - was the main culprit. a 10 year veteran of the denver police

. >>> tarhonda thomas is here with more on the justice department's review. people will be surprised to know who made the review. >> reporter: the interim police chief requested the rerue. he, the mayor, and city manager asked the feds to review commerce i police department representatives with the u.s. justice department will be in town. the justice department has a special office, community- oriented policing services or c.o.p.s. for short. a rep will be part of the announcement. over the last year, there have been several embarrassing incidents. one officer is facing criminal charges, accused of inappropriately touching three women during traffic stops. john reinhardt has since resigned. misdemeanor and a felony charge. this officer, kevin lord, pleaded guilty to fake his own shooting. he told investigator he was shot during a traffic stop and identified a suspect in a lineup. lord is no longer with the department. city leaders worry this and other incidents may damage the public's trust in the department. that's why they requested the investigation. these

tarhonda, thank you. ryan? >>> a man facing charges for an assault on the highline canal trail may another attack at the same place. brookheart is accused of attacking a woman on the trail. the woman managed to snap a photo, which would help police track him down. according to a police report, he got into a fight with the woman, he said, when her dog tried to bite him. he faces charges of second- degree assault. another assault happened on the trail a week ago. police are looking into whether he had anything to do with that denver in later than they hoped monday night. their flight from albuquerque was delayed more than three hours after someone noticed a suspicious item in the cabins. passengers were evacuated and the plane was moved to a remote area on the airport property. a spokesperson didn't know what the item was but was deemed safe. >>> d.i.a. is dealing with its own problems this morning. a united airlines employee is being accused of stealing someone's jewelry at the airport. rafael magano was suppose

"consumer reports" has important advice. one trip cost mary that lot of money. she found out when her card was rejected at the gas station. >> i ran home to check my account and relied money was missing and a lightbulb went off something weird had happened. >> reporter: a skimmer copied camera to record you type your pin. >> most commonly they use the information to create a duplicate card. >> reporter: covering the pin bad is one way to thwart the scheme but thieves use a device that does not use a came at all, a fake item that your pin number. >> it savers it. >> it's attached with double sided tape so if it's tugged loose, don't use it, and alert store management. >> reporter: this is another type of skimmer you wouldn't be able to spot because it's deep inside a gas pump. atms are also compromised by deep insert skimmers.
