we joins news 4's terri hendry with the latest. and this is a case everyone believes will probably end up before the nevada supreme court. >> reporter: well, you know, shelby, that does seem likely. the judge in this case, judge james wilson, we don't know when he is going to make a decision, but we know two things tonight. the first thing is he wanted to hear the merits of this case. the state was completely surprised to learn that he had rejected their motion to dismiss. the other thing is both sides say even before the decision is reynoldsered that they will appeal. and if they do what they say they're going to do, it will end up before the nevada supreme court. judge james wilson listened from the bench to both sides of the arguments. this lawsuit was brought forward by parents challenging the constitutionality of the program. among other things, they say nevada's education savings program will take public money away from public schools. >> as a parent, i looked over this legislation and it is going to take money out of the pub

terri hendry has more on the search and the challenges that many challenges and more still to come. >> reporter: that is true. this is all unfolding at the sugar bowl ski resort. the weather has not been cooperating. the threat of more avalanches is hampering the search efforts. carson may disappeared last thursday. they say he was last seen skiing while off duty that afternoon. his friends reported him missing on friday morning. his belongings were found still inside his locker at the resort. >> we are in day four of the search. day five of our missing person. >> reporter: since friday, sergeant hunt said they have been focusing on an area north of the amount due to lift. >> we are doing a search on the trees were carson would normally ski. >> reporter: he said there are 42 searchers on the ground and the search is also being done by air. because of dangerous avalanche conditions on the mountains. >> it is high and it is concerning. we will not putout have -- researchers in an avalanche >> reporter: over the weekend, the weather hampered the efforts. there is now rain in the forecast

news 4's terri hendry joins us now. details. we learned the identity of the man killed at the hands arena police but there are still a filled in. and they are hoping that you can provide that information. conference, sports police identified the man as 38-year- old sergio alvarado-morales. we don't know much more. that's where you could help by police. >> anybody who may have known this person, who may have information to help us piece together what led up to the crash and the subsequent officer involved shooting. little more about how all of this unfolded. authorities say it started with a crash involving four or possibly five vehicles. they are hoping if there is a fifth vehicle, that person, forward. they say alvarado-morales was involved in the rack but don't know what happened before the crash. and are looking into a lot of factors including whether road rage was a factor. they also confirm alvarado- morales was armed with a knife. and threatening to harm himself. they say one officer tried to subdue him using a taser, but

terri hendry is here now with their latest on this. critics are hoping to get this issue on the november ballot. >> reporter: they are hoping that voters return the rate change. first thing, numbers of a newly formed approach solar alliance found a referendum petition. they are hoping to collect 55,000 signatures to get a november. existing solar customers say the new math makes it impossible for them to recoup their solar investment. across town, other supporters were marking a small victory. they were able to convince the puc to hold another meeting to reconsider grandfathering in existing residential solar customers at the old rates. critics say the decision is not only hurting them but killing jobs and destroying the rooftop solar industry here in nevada. >> we hope to accomplish shedding light on the fact that a three-person commission nominated by the governor has effectively killed an entire industry. >> i want the puc to think about the impacts of their decision and not just for those who have already invested but for the many
