abc7's terry mcsweeney is in san francisco's diamond heights neighborhood.e has more information on the fire. terry? >> reporter: the investigation going on. the street berkeley way blocked off for 100 yards. you can see the san francisco police talking to firefighters. leaning against the front of the fire truck in front of where the house burned yesterday. take a look at the fire. at the four-story house burning at 11:00 yesterday morning. sky7 also with pictures of a firefighter treated with less severe injuries. firefighters inside that house reported a flashover. you get an idea of what it is in this training video. smoke building up, forming the cloud combustible gases at the ceiling. then it ignites sending temperatures in the thousands of degrees. that is what apparently killed the one firefighter critically injured. the other. residents were long gone by the time flashover happened and they are okay. up on berkeley way right now, the investigation continues in to what started the fire in the first place. live in san francisco, terry mcsweeney, abc7

live in the south bay bureau, terry mcsweeney, abc7 news. >> terry, thank you so much. >>> 6:06. in alameda, officials have now reinstated a training program for firefighters in land-based water rescue after huge community outrage following the drowning death earlier in week. last night, the city decided it will spend 20 to $40,000 to certify 16 firefighters in land-based water rescues. it follows monday's drowning of a 52-year-old suicidal man who died in the cold bay water while firefighters and police stood and watched from the shore. fire and police officials say they couldn't go in after him because they're not certified in that type of rescue. and if something went wrong, the city would be open to liability. the certification program was previously cut due to budget constraints. last night, angry community complained to the alameda city council. >> this just strikes me as not just a problem with funding but a problem with the culture of what is going to go on in the city that no one would take the time to help this drowning man. >> could we have done more when the gentleman

abc7's terry mcsweeney is live in the newsroom with details. terry?> two weeks ago, governor brown vetoed a budget because it included too many accounting gimmicks. now he is agreeing to one that counts on billions of dollars that don't exist right now. governor brown and democratic lawmakers say the deal assumes $4 billion additional dollars in the upcoming fiscal year. that is not only wishful thinking, it is based on higher than expected revenue figures in recent months. the governor is giving up on a plan that would have let voters decide the fate of tax increases. he couldn't persuade four republicans to go along with the idea to get it on the ballot. >> i thought we were getting close. but as i look back on it, there is an almost religious reluctance to ever deal with the state budget in a way that requires new revenues. >> well, here is the budget plan on the table today. redevelopment agencies are eliminated. that may face a court challenge. sales tax on online retailers. vehicle registration fees did go up $12. deep cut to higher education. i

terry mcsweeney joins us live from the jail with the rest of the story. terry, i've never heard anything like this before. >> reporter: it went from the silly to very serious. 20-year-old deshon marman is here at jail. this afternoon he is going to be arraigned on battery and resisting arrest. it all started with him wearing his pants too low. take a look. he was wearing his pants too low yesterday at san francisco international airport. he was going back to new mexico where he plays football for the university of new mexico. before he boarded. an employee asked him to pull his pants up. he wouldn't do it. he was asked again and refused again. >> at that time, they made a citizen's arrest of the passenger and the passenger was asked by the police officers to leave the aircraft at which time he refused to do that. the captain then asked the passengers around him, in fact the whole aircraft to de-plane for their safety. >> everything was cool and everything was fine. >> everything was not fine and the mom says her son came back to attend the funeral of a cl

live in san francisco, terry mcsweeney, abc7 news. >> thank you. east palo alto police are engaged in a new crackdown on gangs. officers hit the streets this morning making parole and probation sweeps in the wake of the shooting death of a 3-month-old baby. we got to ride along with officers. abc7's amy hollyfield joins us live from police headquarters. >> reporter: the murder of that baby did motivate the sweeps. they are still looking for another suspect in that killing. they say you never know when they are out there looking around in the community, they might get lucky. they might find something. so police officers spent the morning checking up on suspected gap members who are on parole. they have no reason to believe the people played a role in the murder of the baby. but officers say you never know someone may know something. and be willing to talk. so they want to get out there on the street. a couple of years ago, officers tell me they did the sweeps at least one a week, letting gang members know they were watching. they say they got busy a

terry mcsweeney is live in hayward. >> reporter: the search is going to begin at this buddhist churchre asked to come down here 18 years of age or older to start the search for 26-year-old michelle le. take a look at a picture of the missing woman. she was last seen three weeks ago at kaiser hospital in hidden. 25 people have been questioned in this case. no arrests, no sign of le and this is a homicide investigation. last week. investigators have searched southern alameda county but the search is going to be in specific locations and not going to be random, it's going to be based on evidence including cellphone, call times and contact numbers. >> from our phone forensics, f.b.i. as well as an independent contractor our own personnel all come up with ideas what the phone forensics mean and we're following up with that. >> le's family put out the call with a formal announcement yesterday. people that come down to this buddhist church is going to get training in how to go about this search. they will be getting that from a polly klass the girl that was killed back in 1993. make sure you

terry mcsweeney is live with reaction. >> reporter: jaycee dugard was not there in person to the people that held her captive for 18 years but she did get her message across read by her mother. take a look at video this morning. 60-year-old philip garido. 431 years, his wife nancy has been sentenced to 36 years to life in prison. in june of 1991 they kidnapped jais jaycee dugard and took her to a house and for all those years she was raped repeatedly and two children fathered by dugard. here is a quote to philip garrido. i chose not to be here today because i refuse to waste another second of my life in your pleasant. i hated every second of every day for 18 years. you stole my life and that of my family, end quote. >> the attorney for nancy garrido talked about his client. >> i spoke briefly on behalf of nancy giving an apool describe. she said the words are not enough and what i did was evil and every time i look in the mirror reminds of how evil i was. >> garridos were arrested after philip brought dugard to a visit with the parole agent and the plot unraveled. a few minutes ago, a u

terry mcsweeney joins us from the newsroom. is there any republican support. >> reporter: just like for the governor's plan, zero support for this. the democrats have a balanced spending plan. some say there is little more accounting slighted of hand to deal with a deep-seated problem but if the budget doesn't pass, in keeping with proposition 25, the lawmakers lose their paychecks. the deficit is about $10 billion. republicans want to cut spending democrats are picture governor's plan that relies on tax extensions and but it needs a majority plan that nobody wants but the democrats tried to put a positive spin on it. >> we will pass a budget that is not only fair but will make a huge dent in the california structural deficit. >> it will tax online stars like amazon.com and bumps of registration fees of your car. it cuts higher education. public safety and revise portions of a plan to sell state buildings. if it is approved by both houses it would mark the second time in 25 years that lawmakers have met the constitutional deadl

terry mcsweeney is live with reaction. >> reporter: jaycee dugard was not there in person to the peoplehat held her captive for 18 years but she did get her message across read by her mother. take a look at video this morning. 60-year-old philip garido. 431 years, his wife nancy has been sentenced to 36 years to life in prison. in june of 1991 they kidnapped jais jaycee dugard and took her to a house and for all those years she was raped repeatedly and two children fathered by dugard. here is a quote to philip garrido. i chose not to be here today because i refuse to waste another second of my life in your pleasant. i hated every second of every day for 18 years. you stole my life and that of my family, end quote. >> the attorney for nancy garrido talked about his client. >> i spoke briefly on behalf of nancy giving an apool describe. she said the words are not enough and what i did was evil and every time i look in the mirror reminds of how evil i was. >> garridos were arrested after philip brought dugard to a visit with the parole agent and the plot unraveled. a few minutes ago, a u.c

i'm terry mcsweeney. >> i'm kristen sze. begin here, san jose police officers laid off over the city budget crisis are turning in their badges this morning. nearly 70 are losing their jobs at time when public safety demands more of them. amy hollyfield is live at the police department. amy? >> reporter: it will be a somber morning at the police department. they're due here at 8:00 a.m. to turn in their badges. the city has a $15 million budget deficit to deal with. the city couldn't reach an agreement with the police union on pension reform. so layoffs are the result. this comes as the homicide rate is on the rise here in san jose. there have been 28 homicides this year. that is more than they had all of last year. also, this is happening right before a busy holiday weekend. >> we have stepped up, we have overtime positions that are available. so that we can respond to events over this one weekend as a holiday weekend. that doesn't touch the weekend after that, which is still going to be a hot summer night. >> mayor chuck re

. >> i'm terry mcsweeney. it has been a busy morning for the coast guard. it's had to rescue three men off waters off the cliff house. one in bad shape and now the focus shifts to the boat itself. amy hollyfield has the story. >> it's light outside and we can get a good look at the boat or what is left of it. most of it is submerged here in the ocean where 600 yards offshore at the cliffhouse restaurant. the coast guard now wants to head out there to see what they can recover. the three fishermen who were on board are okay. the boat capsized at 12:40 this morning. all three of the men went in the water. they had a life raft on board. the coast guard found them and they were floating safely. they were okay. they had 270 crab pots on board. 80 of those were full. they said the load shifted and it caused them to shift. >> we had a load of gear and it shifted on the deck. it went over and wouldn't come back. that's all of that, it happened real quick. >> they don't think weather was to blame. they say it was a clear night and they think it was a load shifting i
