terry mcsweeney joips us with the latest on the search for daphne. >> reporter: the mother is 31-year-old tiana davis. she was convicted in april for child endangerment. she was found passed out on drugs and alcohol behind the wheel of a parked car. the child in the back state. the mother is not a suspect, the father is not a suspect and police aren't talking about where this investigation is going. we found out where it might be headed by talking to both parents and both have been talking to police. ♪ even though my heart is breaking ♪ >> reporter: tiana davis sings for her missing 21-month-old daughter, daphne webb. she was reported missing last wednesday by john webb. he told police he left daphne in his car for two minutes while he went into a market. he says when he came out she was gone. arrested last week for child endangerment for leave the car in the child up protected, the d.a. never charged him. >> i went down today and they told me that they had some tips in atlanta, georgia. you know, people around here basically on drugs. so some of the tips are far-fetched. >> reporter: pol

terry mcsweeney is off tonight. we are following a story about a shooting at home depot while they were open and full of shoppers. kimberly joins us with the latest. >> this is where it happened right behind me in the garden center here in hayward. it's a home depot that is very busy, especially on sundays. a spokesperson said they did not think customers were at risk and the store did remain open today as they conducted their investigation into the shooting. hayward police say two loss prevention security officers industried to stop a plan walking out of the store with a cart full of unpaid for tools. he pulled out a gun and shot one officer and struck the other on the left side of the head with the gun. the suspect was last seen running across the street. he is described as a light or white skinned hispanic man. about 6 feet tall with a short grayish hair style with a pony stale. shoppers who were here at the time describe it as chaotic. >> we pulled in just when the first officer arrived and there was hysterical

>>> good evening, i'm terry mcsweeney. i'm dine dwyer. we begin tonight with developing news out of san francisco. a muni crash sent nearly two dozen people to the hospital this afternoon. the light rail collided with a van on a busy street in the bay view district. jodi hernandez is in san francisco with the latest for us. >> crews just finished clearing out the remaining debris at third and evans. muni service was just restored after a crash involving a muni train brought things to a standstill out here, and sent more than a dozen people to the hospital. the accident happened just before 1:00 this afternoon, we're told a van and a light rail train were traveling parallel toward downtown san francisco along third street, when the van made an illegal turn right in front of the train. the van then crashed into a signal post which fell into the train's window. police tell me another large metal piece of the train's conducting system also smashed into the window of the train. 19 people were taken to the hospital with minor to moderate injuri

terry mcsweeney joins us live. >> reporter: the city of richmond and chevron cannot agree who exactly is dropping the ball, but there are three air quality monitors on the property here at the refinery, ready to go out to the local neighborhoods to monitor the air quality. while they're discussing who is dropping the ball, the monitors are sitting here, unused. august 6, 2012. an explosion and fire, smoke sent 15,000 people to hospitals looking for treatment. but just how bad was the air that day? air monitors are now available to provide the answers in the future. a spokesperson for chevron says as part of a 2010 agreement with the city of richmond, we have purchased the air monitoring equipment and are ready to deploy it once the city approves the locations and work plan. we are committed to working with the city to have this equipment operating in the community as quickly as possible. chevron was ready to start monitoring last year, but the proposal was nixed. which ever side is stalling the process, more penalties are on the way from the county, state and bay area quality manageme

i'm terry mcsweeney. >> most eyes were on oakland where last night a similar protest turned violent. we understand that the protest has been mostly peaceful so far? >> reporter: that is right. protesters were blocking the intersection of broadway and 14th most of the evening and they left, marching east on broadway and five minutes or so they showed up back here again. police are here as well. police are now following them down the street right next to city hall. there are reports while they were away a photographer with the oakland tribune was at alled -- saw assaulted by protesters. >> protesters yelled at drivers. across from city hall where 20 to 30 demonstrators staged a protest late into the evening. earlier by the hundreds, protesters marched through the city of oakland shutting down streets as they went and followed by dozens of police officers. once they returned, they blocked the streets and said the verdict had something larger to say about race in this country. >> we want to call out the system for what it is, a racist system. >> reporter: some believed the experience of

"today in the bay's" bob redell live with how one of the pets helped save her life. good morning. >> reporter: yes, good morning, marla. this house fire in south san jose, inside and outside the house, you have the crates that contain the bodies of as many as 100 cats, inside the van is the woman who is lucky to have survived. her smoke alarm was not working, but she had bunny, one of her rescue dogs, who did awake her around quarter to 2:00. she was asleep on the couch and awoke to find smoke and fire coming out of the bedroom in the back. she was able to escape with her dog to an enclosure in the very backyard. small enclosure, 8x12, secured to keep all of her cats inside. unfortunately, it kept her inside as well. she couldn't get to the key. what she did was she hunkered down, went int
