i'm terry mcsweeney. >> i'm laura garcia-cannon. those overnight fires are added to four other fires seen here on this map. that means it's been an exhausting 24 hours for san jose firefighters. peggy bunker is live at the scene of the most recent fire on 28th and san antonio streets with the latest. good morning. >> reporter: you think in the recent days they deserve really a slow day, the san jose fire department. there is no rest for the weary. in the past couple of hours we're looking at four different fires set within blocks of each other. we're only about six blocks from the warehouse fire we covered yesterday. first of all, the first fire that happened was about 3:30, at 24th and san fernando. by the time we got throughout was a second fire, that one happened at 34th and peach. the homeowner there awoke to see her porch on fire. look at the damage. you can see burn marks all the way up the wall. she was shocked and2ic confuse. why somebody would set something on fire allegedly on the porch. it did look intentional. we're hea

. >> i'm terry mcsweeney. >>> new this morning milpitas police are investigating the city's first homicide of the year. officers responded to reports of shots fired at executive inn hotel on dempsey road. that's near 680, this happened 10:30 last night. bob redell joins us live by the scene with new details in the investigation. good morning. >> reporter: good morning. here we are several hours after the homicide here in milpitas. you can see police are still out here processing the scene at the executive inn. the coroner hasn't arrived to do their part of the investigation. no arrests, no description of the person who shot and killed a young man in the parking lot of the hotel. but what could help the investigators are witnesses. apparently there are several who police have been interviewing overnight at the police station. when police arrived around 10:30, several people were in the parking lot. they were hysterical, crying because on the ground, unresponsi unresponsive, a man, 20, 25 years old with a gunshot to the face. he was pronounced dead within 15 minutes of the officer's arrival.

. >> i'm terry mcsweeney. charges could be filed against a man who admitted kidnapping a 7-year-old girl from her owner driveway. christie smith live with more on the case, including his bizarre jailhouse interview. >> reporter: good morning. the district attorney here in martin is expected to get the case from antioch police later this morning. the man accused of taking the 7-year-old girl, he's speaking out already, explaining in his words that this whole thing was a cry for help. claiming that the government has been following him for years and told him to do it. that's what the 43-year-old douglas told nbc bay area news from his jail cell in martinez, adding he did not harm the girl, who is at home safe. he scanned an antioch walmart parking lot looking for a person to kidnap. the -year-old girl appeared to be the easiest person, so he followed her and her mom home in antioch, where he took her. he also says he came close to snatching three others over the last week. >> i did follow people up to that point

. >>> good morning and thanks for joining us, i'm terry mcsweeney, peggy bunker has the day off. we're learning new details about the deadly flu bug going around. it has claimed nine lives so far. people are listening to health officials and getting their flu shots and i'm thinking that's exactly what health officials are saying. >> reporter: that's exactly right. i spoke with a, woer at the pharmacy here this morning, and he said they only have a few flu shots left and they're hoping to get some more in. i asked if they might be able to make it through the end of the day, and he said i just don't know. they have been really busy as the word spreads about this early and aggressive flu season. nine deaths so far in the bay area counties. one patient was an otherwise healthy 23-year-old. now, we did just hear from the california department of public health and they're reporting seven deaths with 28 more under investigation. patients are being created outside in a tent. they have two tents up now, but a spokesperson just told me they're going to consolidate to one today. healthy you

we begin with terry mcsweeney, who is live at the apartments in dublin, with what went wrong. terry? >> reporter: the b.a.r.t. police department has been around since 1972. not once has an officer been killed in the line of duty, until today. investigators from the sheriff's office, the fbi and dublin pd left here in a caravan. the overall investigation far from over. the investigation continues into the night. the sheriff's office mobile crime lab, fbi, and dublin police, all trying to figure out what went wrong out here. a spokesman says it happened about 2:00 when a number of b.a.r.t. police officers moved in to do a probation search of an apartment. >> they went into an apartment, and it was during that search that one officer fired his weapon, which fatally struck another officer inside of the apartment. >> reporter: dead is 42-year-old thomas smith. a 20-year veteran of the department, shown here at a recent press conference. the person on probation who lives at the apartment was not home. in fact, in custody. and b.a.r.t. officers knew that, but they were not sure if any

>>> good morning, thanks for joining us, i'm terry mcsweeney. >> i'm peggy bunker. we begin with a story new at 11:00 this morning, a bay area golf coach accused of abusing students was back in court this morning. bob ridell is live there this morning. >> good morning, peggy, andrew nezbit has been charged with ten new counts of abuse of a child. that makes seven boys that have come forward with these accusations. he did appear in superior court this morning, but did not enter a plea. instead he asked the judge for more time. his next court appearance is scheduled for february 20th. his mother, seen here comforting his wife who appeared to be very upset. she and his parents declined to speak with us as they left the building about an hour ago. nisbet taught golf in livermore. police arrested him last month after two students, both boys, accused him of sexually abusing him. it took place between plait 2009 and the start of spring 2012. taking place in his car, home, and out of town golf trips. he was a very popular person as a golf coach and successful, helping his s

. >>> good morning, thank you for joining us, i'm terry mcsweeney. >> i'm peggy bunker. >>> the man accused of dousing the chinese concentrate late in san francisco with gasoline and setting it on fire is back in court this morning. christie smith is outside of the courthouse with the latest on that. >> reporter: it was a very brief court appearance for the man. it maybe lasted two to three minutes. he had the preegings explained to him with the help of than interpreter, but he did not enter a plea today. he had an attorney appointed to him. he was wearing red which i'm told is for protective custody. according to court documents he burns the concentrate late because he was hearing voices in chine chinese. they told reporters that someone brought containers of gasoline and lit them. he was arrested for arson and damaging the property of a foreign government. investigators say they have no reason to believe it had anything to do with terrorism or a political statement. >>> the concentrate late has called for more security provided by the u.s. government saying again that he is due back in co

terry mcsweeney joins us in san ramone this evening. >> reporter: here at the police substation in san ramone, you can see the flag at half staff. you'll see the very same thing at the state capitol at the state capitol. for the next few days, you'll be seeing officers throughout california with a black ribbon on their badge in honor of sergeant smith. tonight, we're finding out we have lost one heck of an officer. in san ramone tonight, flags of tribute fly in the neighborhood of 42-year-old sergeant thomas smith, the 20-year veteran of the b.a.r.t. force, killed accidently yesterday during a probation search in dublin. >> we're shocked and we're grieving. please give us some time. >> reporter: a visibly shaken chief talked about the first officer in the b.a.r.t. pd's 42-year history to be killed in the line of duty. >> both professionally and personally, he will be missed. >> reporter: smith and six other b.a.r.t. officers went to the apartment of 20-year-old john henry lee, knowing he was already in custody, to recover items stolen at a robbery. a sheriff's department spokesman says

. >> i'm terry mcsweeney. we'll have much more on the niners' big win in just a moment. investigators say an overnight fire in san jose is not the work of a serial arsonist who struck at least five times over the weekend. they say this fire started when someone dropped a cigarette on a porch. the people who lived there put the fire out before crews could etch arrive. it was a nice break for san jose firefighters who had to deal with 13 suspicious fires near downtown san jose in less than a week. all the fires were set between 2:00 and 6:00 in the morning, including five this weekend. police released this sketch of someone they say is a person of interest in this case. he is described as a white or hispanic man between 25 and 40. he's at least six feet tall. weighs about 170 pounds. he also wears large frame glasses. the firefighters tell us they were relieved the arsonist did not strike again and that neighborhood vigilance may have helped keep him at bay. >> certainly getting into the morning hours without having a fire is a relief. so, you know, we're kind of hoping th

good evening, everyone, i'm terry mcsweeney. >>> new at 5:00, tens of thousands of demonstrators gatheredin san francisco today for an anti-abortion march and rally. this is the tenth year for the walk for life west coast. though the event is over, it continues to have an impact on traffic in and out of the city right now. monte francis with the details. monte? >> reporter: terry, good evening. the event wrapped up about two hours ago, and traffic along the embarcadero has really improved in the last 15 minutes or so. in the last hour, marchers were making their way back to their buses. just beyond at&t park. earlier today a massive crowd gathered at civic center plaza for an anti-abortion rally. before marching down market street to the plaza. many protesters were bused in from other parts of the state. we saw many churches from the central valley that were represented here, from places such as turlock, fresno, even some from southern california. we understand a much smaller group of about 100 pro-choice demonstrators were at market. this is the tenth year for the walk for life west coas
