texas is generally a conservative state, a republican attorney general, urging the court not to take the case. they didn't want them to go further. after it was granted, texas hired an attorney. in our group, the higher you know him, upped the stakes in terms of what the representation would be. he won the name els case we were talking about. in some ways to have someone with the conservative credit of having been in the w. bush administration and coming in a very nonideological way will help texas' case as much as it could. >> he was on the winning side of the michigan case. he did a very good job in lawyering through a difficult case involving christian legal society at a law school and whether it could bar gay students from leadership positions. i agree with joan that having him in the case makes it all the more interesting. >> let's open up the floor to questions. i'm going to give up my mic. this is arnold. >> i have a real quick question. with regard to the health care decision, not so much the health care decision itself, the medicaid part of the decision that was struck down.

on affirmative action, the thing to watch is whether it will be a texas-only case or a national case. >> i would bet the white plaintiffs are going to win somehow in that case. otherwise, there would not have taken it. texas had a top-10 system. the top 10 graduates of high schools around the state were automatically admitted to austin. they had a good amount of diversity through that system. in addition to that, texas started using race as an emissions factor. the challenge is really to the extra use of race. the court could say as long as you have got diversity through this one system, you cannot go beyond to consider race. that would be essentially limited to texas. on the other hand, they could say more broadly that any use of race is unconstitutional, and we disavow what was said in the michigan case. that would be a big deal that would affect universities all around the country. >> it is interesting how different it is around the country. california has a constitutional amendment that disallows using race in college admissions. it is interesting that this case comes from texas.

and take a step back for us nationally beginning with the future of the texas law. at does it mean nationally? lots of states are active in this area? >> there are a lot of states active in this area. some states have managed to enact voter i.d. laws without any sort of problem because they're not under the thumb of the federal government as it were under the voting rights act. those states such as indiana have managed to get it through those cases have gone to the supreme court and been okayed. so there's an enormous amount of resentment in states like texas. why do they get to do it and we don't get to do it. why is it okay in that state and not in our state. this case like most of these cases is destined to go to the supreme court eventually. but at the moment it is as you said before a three judge panel in federal district court in washington, d.c. where the state of texas is trying to compel the justice department to give it the okay to implement this law. >> as the governor rick perry in texas commented specifically on this, publicly? >> i haven't heard him com

jon: right now a legal showdown underway. it pits the state of texashe justice department over the lone star state's proceed proceeded sraoeuter id law. chief washington correspondent james rosen is live at the u.s. district court in washington with a look at that. >> reporter: good afternoon. one of the top elections officials from the state of texas was the trial's first witness this morning where he spoke of some 50,000 dead people and convicted felons remaining on the voter roles. attorney general eric holder the named defendant in this case of texas v holder has used his authority to block texas from enact being the voting measure its legislature passed some 14 months ago and which requires all registered voters also to possess a valid state-issued photo id or to obtain one for free. doj attorney elizabeth west fall argued this morning that the texas legislature was quote motivated at least in part by an unlawful discriminatory purpose against minorities. speaking to a latino group yesterday the attorney general eluded to this showdown with texas.

and we will find out whether a federal court in texas will, as wellis set to rule on the vote are i.d. law and whether justice department can continue blocking it. critics of the law like the vice president claim that it is discriminatory against minority voters but folks disagree and you may remember him, the firm justice department whistleblower accusing the department of racial bias when they dropped charges against the new block panthers in the 2008 voter intimidation case. a legal editor. very good to have you. what is your sense of the legality of what texas is doing? >>guest: well, listen, they probably are going to have a tough time when the verdict is issued because the law is stacked against them. the voting rights act was amended in 2006 to require states like texas to show an absolutely clean soul and they have the burden of prove they have to show there is in discriminatory effect, in discriminatory intent so the law puts them on the defensive. i am not optimistic they will win. >>neil: what is the issue at play here? that they require yo

but if you're a slave in texas, forget canada, go to mexico. so wherever there's free territory, slaves went and tried to build a life for themselves away from slavery. and i think one of the points i hope that came out in the lecture is that there's clearly a concept of what freedom means and they may not have written letters saying, you know, treatises about the nature of freedom and liberty, but you have to get at it by looking at their actions. if you are a republican, the idea of texas as a swing state is probably a very worrying idea. but look, texas has now officially become a majority minority state as of the last census with latinos leading the new majority group in texas. if you're a republican politician, the view from the top of the ticket on the subject of your appeal to latino voters is not a good view. in the latest latino decisions poll which was just released today, president obama's lead over mitt romney among latino voters is 48 points. not that he's got support of 48% of latinos. 48 points is the margin of president obama's lead. this is a big republican problem. so what does the republican party do about the horrible polling with the fastest growing minority grew in the country? >> there is this new ad airing in a handful of states featuring a handsome romney offspring speaking in spanish about the family's mexican roots. last week, we reported that the romney campaign was spending just $10,000 on that ad in order to get it on the air. today, the washington post reports that the romney campaign is upp
