when the american legion says the v.a. has a problem with access and leadership, we don't want to throw out the v.a. we want to make it what veterans deserve. the man i told you about in colorado, he had been let down by the system. the system was supposed to care for him. he was broke. he felt broken. and he spent his last $40 on a cab ride to get to the american legion crisis center. all of his worldly possessions on his back in a knapsack. he arrived at the crisis center after it closed that day, so he had to sleep at a gas station waiting for us to open. the next morning, we were able to get him in front of the v.a. and that gentleman was placed in a housing program and received the services that he really needed. our chairman of veterans affairs rehabilitation for the american legion was so affected that he gave that gentleman back his $40 because the american legion truly believes that no veteran should have to pay for services they have already paid for by virtue of their own service. we've served over 2,000 veteran

is the legislative director with the american legion. re have your efforts been focusing in the past couple of weeks? have primarily been working with veterans at the ground level to work with each of the sites identified as trouble spots within the department of veterans affairs. we have been speaking directly with veterans and we have been helping them process their clients, helping them get through the bureaucracy. we are identifying some of those folks who have waited longer than necessary and we are working not only with veterans but the department of veterans affairs to try to ensure these veterans get the care they need. closely with congress to try to develop legislation that will address getting these legislations off the backlog. i especially appreciate the fact you set aside a special line for veterans because they are the quintessential nonpartisan issue in congress that really does not need partisan bickering. that is why it is important we work on this together. like things were working along pretty well but late last week,

the american legion is of course a classic example. americans getting together to share their stories with each other, because they feel like they can't share a lot of the stories with the civilian public or even family members. it is interesting, because you will run into hemingway -- whenever you have people talk about american war memory, hemingway is one of these things that comes up. i think it is good for us to push back a little bit on the story, the way you have done now, and figure out, what is the heart of the story? disillusionment does not really fit in, or that word is too general to get at the heart of what hemingway is actually writing about. since i brought up the big d, let's bring up charles carrington. charles carrington wrote a memoir that is no longer in print. he did write a kind of revised half history, half memoir called "soldiers from the war who are returning" which is still in print. it is the memory of a junior officer serving on the western front. it shows principally two battles. like so many british soldie

you visited 13 facilities i believe, el paso was one of them of the the amazing vernea jones and american legion also set up a command center there within the last month. that shows us that you're taking this issue seriously, but it also shows us we have a problem in el paso. the access rankings that we saw from the v.h.a. reported in june show that out of 151 facilities, we were dead last, absolute worst for established veterans access to mental health care appointments. we were fourth worst for new veterans access to mental health, and second worst for specialty care. you and some of your comments you made while in el paso talked about problems with the capacity of the facility that we have, the quality of the facility that we have. i'd love for you right now to say that i'm going to help you with a full service veterans hospital. i'm not going to ask you to make a commitment that you can't follow through on and don't have the power to implement, but i will ask you this. will you work with me to ensure that we can increase capacity that we can improve the level and quality and access to care i

when they are found to be inconvenient such as when vba instructed -- obstructed the american legions regional office reviews. limited the legions ability to fruitfully conduct visits, converse with claims processing staff and review disability benefits claims in accordance with its longstanding practice of seeking quality. va now ignores committee staff as well. frequently my staff visits regional offices to prevent technical legal claims review. by way of example on a recent visit, 14 appeals files were reviewed from two regional offices. 12 of those 14 were found to have remandible errors. yet when my staff convened with regional office staff to demonstrate the errors and seek correction for the veterans that had been negatively affected, the regional staff refuses to acknowledge and often even the most rudimentary of the mistakes. quite simply this oversight complicated vba's messages that we're doing great work. so while va may ignore employees, ignore whistleblowers and vsos and members of congressional staff and ignore let's not forget the veterans, they are supposed to serve,

the shooting. ktvu's cristina rendon is here with what she found. >> we went through this 90 page plus document and it is revealing new details about had shooting death of american legion -- the shooting death of andy lopez. they looked into his marijuana use and what effects weed might have had on his behavior. the doctor concluded he last smoked marijuana 75 minutes prior to his death and was likely feeling the effects at the time of his encounter with sheriff's deputies. they hired simulation experts to create an analysis of the shooting. this shows three bullets were found in a neighbor's home. 7-8 shots fired hit andy that day. another picture. this from a witness' cell phone that shows deputies were behind the doors of their cars when he fired and erik gelhaus yelled at andy to put down his gun twice but he turned towards them raising the barrel of the gun according it the district attorney. and the replica gun did not have an orange tip and an investigators perched the -- perched the same gun that came with a warning level that acknowledged confusion could come with altering the gun. there is more to this report. if you would like to read it we posted it on www.

veterans committee on june 17th, which was signed by virtually every major veterans organization, the american legion, paralyzed veterans of america, vietnam vets, iraq and afghanistan veteran, all of the groups. this is what say said, and i quote. "protect and preserve the va health care system. any changes whether temporary or permanent must protect, preserve, strengthen the v a health care system so it provides a full continuum of timely health care to all enrolled americans. the letter continues, "unless the legislation simultaneously sets va on a path to intelligently strengthen health care delivery, expand access and capacity, real walocate, the current problems will inevitably occur." from the veteran organizations. i agree with that important statement. in order to address the long waiting periods, the senate legislation says to veterans around the country that if you cannot get into a va facility, you're going to be able to go to a private doctor. you can go to a community-based -- you can two go to a federally qualified health center, d.o.d. base or indian health service. that means veteran

he was hired by the president to support what the veterans' service organizations from the legion to v.f.w. to paralyzed vets to polish-american veterans and every other organization wanted. that's primarily three things -- bring accountability to the v.a. number one. number two, it's to help those veterans that have had to take care of the vet vans outside the v.a. if they had to wait 30 days or longer. and third, scale up the v.a. that means more doctors, more nurses, more physical therapists, greater capacity, more expansion of community-based outpatient clinics, expansions of veterans' hospitals all over this country. the president of the united states did not hire bob mcdonald. we're not going to confirm bob mcdonald to be president and c.e.o. of a private hospital. the veterans' administration, 6.5 million veterans got care last year. 85 million patient visits. if you're in the v.a. system, you're getting good care. we need people, we need to help make sure everybody has access. that's what this legislation will do long term. that's why it's so important. >> just quickly, my view is this letter has a typo. the typo is th
