that's not how it was sold to the american people. >> it's a penalty. it's a penalty that comes under the tax cold for the 1% perhaps of the population who may decide that they're going to be free riders. but most people are not affected by that. >> but it is a tax on the american people. >> no. it's a penalty for free riders. but since you're bringing up the subject, it's important to note the middle-income families will get about $4,000 in tax breaks and tax credits in order to have their health insurance, to buy their health insurance. so middle-income families make out very well in this. businesses get tax credits to provide health insurance for their workers. so what we're saying is is those who take responsibility get the protections of this bill. those who want to be free riders have to pay -- they either have to take responsibility and buy insurance, and there are many ways for them to do it, or they get a penalty, and the penalty, yes, it is charged under the tax code. it could come any other place, but it's under the tax code. and the tax code

so the american people have no idea. we're on the floor today with the distinguished gentleman from michigan who himself and his father before him said a half a century before, americans need the security of having the guarantee of access to affordable, quality health care. that's what we did. madam speaker, after the landmark supreme court ruling upholding the affordable care act, americans are ready to move on. yet here we are again, voting for the 31st time on a bill to repeal the health care law with no replacement, no alternative, no protections. that's not what we ought to be focused on. americans want to work -- to create jobs and to grow our economy. according to a kaiser family foundation poll last week, 56% of americans believe that opponents of the law should drop attempts to block its implementation. it's time for republicans to end their relentless obsession with taking away health care benefits from millions of americans. if this bill were to pass, insurance companies could once again discriminate against 17

for somebody today to say somehow the american people have prohibited the states by ratifying the constitution, they have prohibited the states from applying the death penalty, i don't know where this comes from. the american people never voted for any such thing. that's what originalism is. what did this mean when the american people ratified it. now there are some -- the death penalty was a phenomenon that existed at the time. there were other phenomenons that existed at the time and those you can't say what the original meaning. when the electric chair comes in you have to decide whether that was unusual punishment. your starting point, your base point against what you compare these later phenomenons is what was approved at the time the 8th amendment was ratified. so, if the electric chair is less cruel, than hanging, it's not prohibited by the 8th amendment. likewise death by injection which is even less cool than the electric chair and certainly less cool than hanging. >> here is another one of your 13 falsely exposed. by the way, who wrote that headline? >> that was your name sake, spell

and we told the american people, okay, we raised the debt ceiling. t of people didn't want to do it. a lot of americans were hot about it. but we said we're going to cut spending by that much over ten years. as reported by publication "c.q." -- quote -- "conrad did not counter session's claim that the outlay limit would allow higher spending in fiscal year 2013." but this is not, let me emphasize, just the fault of senator conrad. this large violation of the budget control act is without doubt the decision of senator reid, the democratic leader, his leadership team and really the members of the democratic caucus who support him. remember, outlays are the spending figure which directly registers on the debt. $14 billion in higher outlays in 2013 means $14 billion added to the debt. it's just that simple. in fact, the higher debt that will accrue next year as a result of the higher spending level means that interest payments, the amount of interest we pay on the debt that we accrue, will be greater and will also exceed c.b.o. baseline limits. as a resul
