sara bloomquist is live outside of the camden county courthouse. sara opening statements and the beginning of testimony what did you learn today. >> reporter: jim only a few witnesses were called today following the opening statements. the most interesting testimony came from brendon creato's mother that the defendant david creato suggested that his son was drawn to the woods by spirits where his body was found. he sat motionless as the trial got underway in camden county court. they toll the case that was carefully instructed to make his client look guilty but he is not. >> he goes by dj david jr. and the accused of -- is the most heinous thing a person can be accused of. but he is innocent. >> jurors heard creato's 911 call when he told police he woke up and found his son missing. hours later brendon was found partially submerged in a creek more than a half mile from his father's apartment. and christine shaw refuted the idea that he walked there on his own the boy's socks were clean and he feared the dark. >> if there is one thing -- brendon love

"eyewitness news" reporter cleve bryan is live at the camden county courthouse this afternoon where thatrial continues. cleve. >> reporter: good afternoon jan. right now the mother of three-year-old brendan creato is on the stand being cross examined by the defense. she testified before that her ex-boyfriend, dj, david jr. creato was in custody of young tren brendan at the time that brendan was found dead in haddon township back in october of 2015. now, this all started in the early morning hours on october 13th of 2015 when dj called 91 saying that he couldn't find his three-year-old son brendan. that led off a three-hour search. ultimately first responders finding the little boy's body down by the cooper river. now, this trial is all about how did the little boy get there and who killed him. right now they believe the prosecution that dj killed his son in an attempt to keep his girlfriend who didn't want to have any children involved in their relationship but as we just heard from samantha, the little boy's mother that up to this point dj had been a loving father so they're trying to g

. >> nbc 10's rosemary connors is joining us live outside the camden county courthouse. what else did the mom say during the testimony? >> reporter: she described that conversation as being odd and illogical. she couldn't make any sense of it. the jury today heard circumstantial evidence and testimony on both sides that the toddler knew how to unlock doors but never wandered away from his house in the past and never left home alone day or night. david "d.j." creato sat quiet in court. the toddler was just beginning preschool at the time of his death. prosecutors told the jury that money was tight and that creato couldn't afford to give the boy's mother the tuition he owed for brendan's child care. >> all i can do is give her a hundred because he needed to save 200 for rent. >> police and investigators who took the stand today testified that officers discovered 3-year-old brendan dead in the creek of cooper river park the same morning creato reported his son missing. creato insists he woke up to find his apartment door unlocked and his son gone. parents and family members

the neighborhood lit up in flamed as the fire tore through her home. >> just can't believe it. >> the camden county fire department says that the blaze broke out at 2:30 wednesday morning. several engines blaired their sirens as they descending on the quiet neighborhood. >> my husband said it was something big and i operated the door and it was shooting up into the air. it was really bad. >> by the time firefighter as rived. the flames were burning through the upper floors of the two family home and embers were flying to nearby homes and rails and new jersey transit briefly interrupted early morning light rail service. >> it's pretty much the top floor so everybody they have is gone. >> the two families live inside were able to evacuate safely and one resident says it's thanks to his dogs that woke them up in time. >> we got water and coats and blankets and all the neighbors up there were helping them. i feel so bad. >> a firefighter was briefly trapped in the upper floors and he managed to evacuate in time and another injured his ankle. the cause of the fire is still under investigation. re

and in the jail here, connected to the camden county courthouse, since his arrest for the murder of his three year old son back in october 2015, brendan creato, just to give you a little rehash of what happened, found dead in the brush around cooper river park, near his dad's westmont apartment. his dad indicted throw month after brendan was found dead. the motions among them one of them, the prosecution wants the judge to let jurors visit that spot where brendan was found, because the prosecution contention is it is highly unlikely the little boy could have walked that long distance between his dad's apartment, and the spot where he was found dead. we don't know the defense strategy at this point, but a lot of people think they're going to think that they're going to argue that the little boy jaws wandered out of the apartment on his own and died of natural causes. we've never gotten firm detail from medical examiner about why, how he was killed, or how he died. so they're going to ask for permission and we'll see if the judge grants it, then again, couple of motion cents, and then the

he joins us live from the camden county courthouse where the prosecution and defense laid out their case, cleve? report report good evening, nicole and jessica. well, they have certainly pointed toward david dj creato as having the opportunity and possibly a reason to kill his son, but is there proof that he did it? we heard testimony from first responders as well as victim's mother as the prosecution laid out the case and what they believe happened. now, dj creato from haddon township, made a call to 911 back in october 2015 reporting his three-year old son brendan was missing. several months later dj was charged with the murder of brendan, k-9 track the boy's lifeless body to wooded area along cooper river a mile from the dj's apartment. prosecutors say it is unlikely that the little boy wand their far through the dark, and, socks were cleaned. several medical examiners ruled brendan's death an homicide but never an explanation instead of signs for lack of oxygen to his brain. now, thinks dj's ex-girlfriend and brendan's mother. she has never been named a suspect but at one point she w

than jury will not just see evidence here inside the courthouse in camden. the prosecution successfully won that argument couple of weeks ago, to take the jury on a day trip, outside, to the spot where three year old brendan creato's body was found. the prosecution doing that because it wants the jury to see and likely walk the .6 of a mile distance between david creato's apartment building in westmont, where brendan was last seen alive and the prosecution will surely argue where he was killed to the spot along a stream by cooper river where his body was found hours after his dad called 911 to report him missing. now, the prosecution wants to counter any argument creato's lawyers going to try to make that the little boy wandered out of the apartment on his own, and walked all those blocks, in the dark, in his socks, down a dark unlit dirt path through woods to the spot where he was eventually found by a k9 dog. his socks, not even dirty, but clean, and not walked in outside. plus testimony likely from his mother who will say that brendan was afraid of the dar
