the coast. north carolina, massachusetts, new jersey. the difference here is that often massachusetts got in major harbors. north carolina doesn't have that. what we found if our research in looking at this landscape, north carolina has some geographical features that lend itself well to u-boat operations. i'll talk a little bit about that more but this is really a u-boat hotspot for a number of reasons. you see that north carolina merges as one of the largest concentrations of losses in both tonnage and in number of vessels. this is just a quick map. i want to mention, my colleague developed a lot of these gis maps to recreate some of these sites. these are the vessels that are just lost off of north carolina. there's ten vessels just in a little over three months were lost off the coast here. i mentioned that north carolina is a very good area for u-boats to hunt. you've got historically north carolina has terrible ports. there's very few ports in north carolina that are navigable for large vessels. so the closest naval installation tha

if i leave the north carolina supreme court -- if i read the north carolina supreme court decision it still hasn't told me , whether it is one or two brake lights. the next police officer who wants to stop someone will not know that either. he might be bound by the appellate court decision, but that will not help clarify the state of the law. isn't what you are doing going to leave criminal law unclear? it is one thing to say you want to not subject officers to civil liability. it is another to say you want to leave the law unclear in a criminal prosecution. >> in north carolina, controlling precedent does come from the intermediate court of appeals. that is not to say the supreme court may not reach a different decision someday. for now, police officers would be bound by what the north carolina court of appeals decides. the law has been decided. an officer who makes a stop tomorrow because one brake light is out would be acting unreasonably under that decision. so it doesn't leave criminal law uncertain. >> it will for the appellate division if it is now taking your view that it can

you are asking us to set aside a judgment of the north carolina court. that judgment could be set aside only if, number one, the fourth amendment was not violated or, number two, it was violated, but the remedy does not have the exclusion of the evidence? it seems to me it is your burden to establish not just that the fourth amendment was violated, but also that exclusion was necessary under the constitution. it is no answer to say that has not been argued. you haven't argued it. that is the problem. >> they need to argue it. i would refer you to the part three argument in the opening brief explains why even if you move good faith into -- those are my arguments. the other case that comes to mind is a case from several years ago. the court divided that federal law question into two pieces. the court reversed on one piece and sent it back down. what i'm asking for is not terribly different. >> send it back down for the court to decide that other piece. but this court will not decide the other piece. >> if a state gives it that choice it's going to give more

isn't that what the north carolina law is now? answer the good faith exception. >> it would not be futile, justice ginsburg. i think the analogy i gave earlier is more or less on point. the court is held that the constitution is violated if they -- that the defendant in the criminal case does not get a remedy unless he satisfies that test. >> that is because they would be applying federal law. they would be answering the question. you want us to leave it unanswered, mainly whether the constitution requires that this evidence be stricken from the case. if it is indeed they are not going to ask that question when we sent it back, it seems to me we have to answer that question here before were able to reverse or affirm the north carolina court. it is a federal question. they are not going to get to that you're asking us to invalidate this conviction on the basis of federal law. it seems to me we cannot do that unless there has been a violation of the fourth amendment. the remedy must be exclusion of the evidence. that is a federal que

this is just the area off of north carolina, the peninsula here. as you can see, these are the vessels that sufrpg, it was successful. the most successful any of the vessels operating in this area. and a focus more specifically, on the harpathennian. no convoy system in place in this area. really, operated on uncontested again, in this column here. you can see, the vast majority of these were using bombs, this is were they would actual lie flag down the vessel, and go aboard people put people ashore, and detonate however some of them were not as lucky. you can see, where there were torpedoattacks under shell fire. higher loss of life. they tried to avoid that when possible. u-140 this is a monster u-boat. they weren't as standardized, the shorter range, still plenty of rachbl to get across can the ocean and do damage along the coast here. they had 40 torpedotubes in the bow, this one, a military vessel had more armorment. reconstruction, war patrol here, across the atlantaic, more attacks on the way over. so, won't focus on those as much as the one

there's a we'll coastal load developing off the coast of the carolinas. so this turns northward as we get into later on tonight but the big story we're tracking as we get into christmas eve, the one everyone is pants pating you'll see this moisture coming out of the rockies so this moisture cuts down to our south, forms this area of low pressure from the south and taps into all of this moisture coming from the gulf of mexico and that will work its way into our region as we get into tuesday night and real into wednesday. so future tracker 6 showing you that moisture developing from the south and it really embodies much of the delaware and lehigh valleys as we get into wednesday morning lasting for much of the day on wednesday as well. so, two rounds of rain tuesday and wednesday, light rain and drizzle. and then christmas eve rain, some of which will be heavy at times and at that point we're culling for anywhere from a half inch to an inch of rainfall on the way. we'll take a closer look at the system and let you know if it pulls out in time for christmas d

a wider view showing that while this low pressure is off the carolina coast there's a piece of upper level energy moving across the midwest and that really has a lot of impact. because what this will do is join forces with that low pressure, intensify it and then roll it up the eastern seaboard very slowly. so, this will be a long duration event and this will be mainly a rain events for the i-95 corridor and areas to the east. so, a flood watch has been posted for tomorrow. we're looking at generally 1 to 3 inches of rain, the heaviest will be areas closest to the east and this likely will cause some localized flooding even the possibility of stream flooding. also there is some cold air at the onset with this system, so the national weather service has issued a winter weather advisory for lancaster, berks county and lehigh valley from 7 o'clock tonight until 10 o'clock tomorrow morning. as that moisture initially moves it in it will bring a brief period of icing tonight for these locations so this is something you really have to be wary of and there is a winter storm warning in:for th

the radar shows the center of our storm system up to the coast of the carolinas. a south to north direction we will watch the moisture invade our region. it's timing the precipitation for you. it mostly rain for all locations. at 6:00 in the morning for the commute tomorrow morning, mixed precipitation across the suburbs. it will change over to rain. areas to the east, you have heavy rainfall to the city on lakehurst and wildwood. it continues as we go through the mid-morning and lunchtime areas. the storm system pulls to the north and east. with a few lingerings7 rainshowers. for philadelphia, the i-95 and areas east, 2 to 3 inches of rainfall. south jersey through delaware. north and west of town you can find 1 to 2 inches was rainfall. the winds are gusting 40 to 50 miles-an-hour. waves as highs as 10 feet and coastal flooding is aq big concern. a wind-driven soaking a dreary day. high of 41 degrees. a high of 39 on wednesday. not sure if you have a coating north and west for the commute on wednesday morning. it stays chilly with a flurry around on thursday. a
