. >> reporter: it's quite out here in front of the branding theater in concorde this morning. it was a different scene last night as moviegoers went into lockdown mode into that theater after the shooting took place outside of the theodore. here's what we know. agree ll officials around 6:45 a subject made its way to the theater and caught -- caused some sort of ruckus. the suspect then threatened to shoot the security guard. they fought and ended up outside of the movie theater near a parking lot. at that point the security guard confronted the suspect again and told him to drop his weapon. ultimately he fired several shots hitting the suspect. he was taken to a local hospital with non-life- threatening injuries. the security guard was also detained and according to officials he was cooperating with the police. during the incident the theater went into lockdown mode. authorities are trying to figure out how that person got inside the theater. we had chance to talk to the concorde police last night. >> was he a customer or someone who snuck into the theater. >> we still have

, massachusetts, who do you think actually started the american revolution in concord or lexington, that's not actually my real question. one of the things you do so well, derek, you bring to light these characters who were lost in all of history and everything that happened throughout the american revolution and certainly leading up to it. so i'm just curious to know, besides dr. warren, is there anyone else who you feel like hasn't been given their due and should be as a historical figure and somebody who was a big influence in the early days of the revolution? >> i think richard montgomery maybe not as big of an influence as dr. joseph warren, but he's the guy i showed leads one of those two prongs up to quebec city, he certainly hasn't been given his due. he's buried here in new york, though. again, i'm trying not to give away what happens in the battle of quebec for those that don't know the story. but he's certainly an incredible leader. he's -- because canada is ignored, he's often ignored, but he is one of the good generals at the early start of the revolution.

wmur's ray brewer joins us now, live at the attorney general's office in concord, with details on the case in effingham. officials with the attorney general's office say that 63-year-old robert dishman died monday at the hospital from a single gunshot wound to the chest. officials with the attorney general's office say there was some sort of incident on ams way -- am's way in effingham around 11:00 monday morning, and a shot was fired. dishman was rushed to dartmouth-hitchcock medical center, but he passed away, and his death was ruled a homicide. it is not clear right now if that incidenpp but we did speak with a neighbor who says a man named bob does live at that address. he was surprised to learn what happened. >> that's just crazy. i don't know. it's -- i've heard him yell a few times, but -- i heard some -- i do not know what it was about. i heard some commotion, but i didn't think much of it. ray: so far, no arrests have been made in this case, but investigators say they do not believe there is any threat to information, you are urged to get in touch with state police. reporting

the story. josh: kristen carosa is live outside federal court in concord. reporter: john doe's mother testified today saying her son was treated unfairly during this process. we also heard from the dean of students today who talked about how the school came to this decision. 15 years old at the time says she received philip exeter academy's decision to remove her son from school through an e-mail this past summer. that after a 15-year-old girl reported a sexual encounter she had with the boy at school. philip exeter hired a private investigator who determined the boy violated the school's sexual misconduct policy. the school says the sexual encounter was not forcible, but she did not clearly consent to everything that happened. john doe's mother told the court she treated unfairly and that she and her family received limited information during the investigation process. she says they requested the investigators final report but never got it and is now seeking reimbursement for roughly $121,000, which includes a year of tuition. schools dean of students also
