you talk about that epic fight at the daytona 500 in 1979 between allison brothers and yarborough. say that was the year that stock racing was born. it is also the year i was born. because drivers with the stakes so high, big purse, widespread, televised race, they were riskier on the track. and i'm sure that's true. but i also know a lot of nascar drivers who are competitive no matter what. they want to drive. they will drive every day of the week, not on television and for no money just because they love to race. is competition sort of endemmic to competitive behaviors, regardless of the stakes? >> just what the scientists would say, the economists would say, what you're observing is true. people intrinsically love to compete. i'm one of them. but they'll take ever more risks and get into fights like that fight at the daytona 500 in 1979, because of how much they've being paid to win. and even as we're totally driven to compete, we're still subtle to the other additional influences. to go to your question, are we, really you're saying is this inherent? are we born with it? we are.

or perhaps the manufacturers of that fence? >> they are going to sue daytonare going to sue. and they're going to say that any small print in their ticket is not a binding contract. they're going to say that daytona knew that there was a dangerous propensity for cars to injure patrons, hence they put up a fence. the question is going to be whether that fence was put up properly, whether that fence was defective. if that fence was put up properly and cleanly, daytona, i think, is going to escape liability. >> really. you talk about the disclaimer on the tickets. on the back of the tickets for daytona race, perhaps some other nascar races, it will say, and in this case it said the holder of this ticket expressly assumes all risk incident to the event, whether a occurring prior to, during, or swent to the actual event. any substance sid yairs are released from all claims arising from the event, including claims of negligence. so why even bother pursuing a lawsuit if it's written there on your ticket? >> well, courts will find that kind of language on that kind of

most of the people chased out by a brush fire in daytona beach are back home this morning. firefighters there say they have it about 75% contained. at one appoint about 300 families had to leave and leave quick because the fire was moving so fast. winds and low humidity have been feeding the fire, those are the same conditions that are expected today. the crew aboard international space station is getting ready to lock down the dragon cargo vehicle. you can see it there. they use the station's robotic arm to reach out and grand prix early this morning. they will dock around 9:30 eastern. we'll be looking at that obviously. you may recall there were glitches when the dragon launched. that's why it's been delayed. this is an unmanned capsule, caring 1200 pounds of supplies for the station crew and their experiments so they are certainly anxious thinkstious to get it. >>> to washington, lawmakers expected back this week. they have some unfinished business to handle. dealing with those forced spending cuts in effect isn't the only big thing on their plate. cnn's congressional co
