if the e.p.a.'s incompetence is surprisingly prevalent as the investigation found, you'd think that this agency should be trying to get its house in order before it takes on new jobs. that's not what the obama administration is doing. oh, no, it's not slowing down at all. it's not slowing down in its quest for more power and more ways that it can control what people do. on friday, the obama administration published the final rule for what it calls its clean power plan. this regulation would create more washington control over how electricity is produced across the country. that very same day, 26 states, 26 states, including mine and that as the president's, 26 states filed lawsuits in federal court to stop this disastrous rule. these states say that the environmental protection agency went far beyond anything that the law allows and far beyond anything congress ever intended. i completely agree. this rule is too expensive, it is too extensive and it is too extreme. now, the e.p.a. does have a job to

the best that e.p.a. administrator geena mccarthy could say is she was deep hi sorry and that the spill was a tragic an unfortunate accident. that's not all. no accountability, no reparations, nothing. how can the american people truths the government agency charged with protecting our environment with the same agency re-- when the same agency is responsible for cause manager damage. actions speak louder than words. this is more of the same from the e.p.a. they are another arm of the federal government looking to bully private citizens. this is nothing new from the e.p. a. almost a decade ago a gentleman from my district faced a costly, almost devastating battle with the e.p.a. mr. paul mcknight owned an old cotton warehouse in georgia. ter a former deadbeat tenant could not afford to remove 2,000 barrels of toxic waste from this warehouse that mr. mcknight knew did not exist. the e.p.a. was called in to inspect the building by some anonymous caller who said that they could smell a leak. once the e.p.a. go

the e.p.a. released their final clean water rule, which completed another chapter in the clean water act's history. as the clean water act worked to restore the health of our nation's water resources, we saw the u.s. economy grow, demonstrating that america doesn't have to choose between environment and robust economy. a clean environment helps build a robust economy. two supreme court decisions, however, call on the e.p.a. and the army corps to clarify the definitions of the "waters of the u.s." the aps e.p.a.'s final rule ress some long overdue certainty to the clean water act. in reviewing the rule, it basically reestablishes the lo longstanding understanding of what are the waters the u.s. this allows the clean water act to continue its important function of restoring the health of our nation's waters. the rule became effective this august but immediately following the implementation on this anniversary there have been unprecedented attacks on the final rule. as the rule came out of federal d

and the e.p.a. we know this because not only has the president said it, even the defense secretary ash carter has said it in front of the armed services committee. now, if this was such a bad bill, you would think this it wouldn't come out -- have come out of our committee for almost unanimous support both sides of the aisle, bipartisan, unbelievable support for this bill, and virtually the same structure that it's coming to this floor. only when president obama stepped forward only when the president came out and said, i'm going to veto it, did it lose bipartisan support. this isn't an issue about republicans and democrats. this administration, the author of sequestration, president obama, set forth a plan that's been dismantling our military and needs to be set aside. what we have in this bill is a bill that fully funds national defense even as the minority leader, steny hoyer, said, that fully funds it at the level requested by the president. now you can say there are gimmicks. you can say there a

ever since the e.p.a. lost a lawsuit in 1991, it hasn't been able to regulate asbestos, a known carcinogen. that was one of the key things that senator lautenberg knew a lot about. it was in 1991. imagine 20-plus years back. the fifth circuit court of appeals in a ruling said in their analysis and in their tests that they put forward, they said the lawyers at the e.p.a. looked at it and said we're unable to regulate asbestos now. we're unable to move forward. and no real activity has taken place since then. there's nothing that says something's more broken if an agency is unable to move forward with the regulatory activities it was set up to do. for decades the risks are there and were there. the dangers are there. but there's really no cop on the beat taking a look at chemical safety. the current system has failed. it fails to provide confidence in our consumer products. it fails to ensure our families and communities are safe. and there's just no doubt that reform is overdue. 40 years overdue. on this sun

on tuesday, the e.p.a. finalized a rule on oil refineries. it's going to require them to install new equipment, to spend more money on something other than creating more jobs or paying higher wages. it's estimated the rule could cost up to a billion dollars and provide very little in the way of health benefits. then on wednesday, the e.p.a. finalized more limits on coal, gas and nuclear power plants. just like tuesday's rule, this one's going to cost another half billion dollars a year. the rule sets the unacceptable amounts of some emissions at zero. finally, on thursday, the e.p.a. released a new limit on ozone in the air. the limit was 75 parts per billion. they cut it to 70 parts per billion. now, this is a tiny change, we're talking parts per billion, but that tiny change is going to cost more than $2 billion a year once the rule is in full effect. huge chunks of the country are going to have to adjust to meet the new standard. and the benefit is minuscule. farms and small manufacturing companies will have to buy new equipment or change t

so i call on the e.p.a. to take a much more focused role in making sure that the citizens of flint have clean drinking water. now, i mentioned that this was not an accident. this was done during a time, this decision to use this questionable water source, was done when the city was under financial receivership. when an appointed emergency manager was making the decisions for the city of flint. so here we had a situation where this emergency manager, this outside new management, is appointed to come in and deal with the issue of fiscal insolvency. and by only looking at the short term balance sheet, made a decision to get cheaper water that turned out to be dangerous for the residents of the city. and actually potentially has nded the city a huge cost to fix what could be hundreds of millions of dollars of permanent damage to the water system as a result of that decision. so an emergency manager comes in with the idea that somehow outside management is the only roblem that this city faces. makes decisions tha

the e.p.a. that are the most damning -- damaging to farmers and ranchers, it's the waters of the united states. certainly the chair is familiar with this. that means that while we have had state jurisdiction of our water for many years, it still is -- it had one exception. that is, for navigable waters. i think all of us who are conservatives would agree. the federal government should have a jurisdiction there on navigable waters because that affects a lot more than just states. and so they tried to do that with legislation. that legislation was offered by -- six years ago by senator feingold of the senate -- he is from wisconsin -- and congressman oberstar from minnesota. and not only did we defeat overwhelmingly their legislation, we defeated them at the polls the next election. so it gives you an idea of the unpopularity of this. and so what the president is trying to do there is what he was not able to do with legislation, do with regulation. well, that's the way it is with co2 emissions. so

and the e.p.a. the legislation the president will veto today authorizes the overall amount for the defense that he requested every single dollar of it. by making clear that he will -- quote -- not fix defense without fixing nondefense spending, the president of the united states puts defense and the men and women of the military on the same level as the i.r.s. the president is using our military, is using our military as leverage to fight a battle that the defense authorization bill cannot accomplish. the time for mounting threats around the world, it's disgraceful. it's disgraceful the president would refuse to authorize our troops the resources they need to prepare for and engage in vital missions around the world and that deliver some of the most significant reforms to the pentagon in more than 30 years. by vetoing this legislation, the defense authorization bill, let's be clear what the president is saying no to. saying no to pay increases for more than 30 types of bonuses, special pay for servic

onerous enough, in august the e.p.a. released the final rule on the clean power plan with an estimated price tag of at least $366 billion, this rule will not only devastate the coal industry by mandating unrealistic carbon reductions, it will also distress american families by causing double-dynel digit elecc rate increases. and the coal industry of wyoming is feeling the impact. the coal industry and businesses and the people that work there that rely on it are facing higher regulatory costs at the same time as energy producers are seeing a tougher market than they've had in years. which is a bad combination for economic growth and job creation. at the end of july, wyoming had 15% fewer energy industry jobs than it did a year earlier, and these are good-paying jobs. that's according to the u.s. department of labor, bureau of labor statistics. most of those lost jobs are in coal, oil and gas and the businesses that rely on them. forget about that ripple effect. given that close to half of wyoming's g.d.p. comes from this

the bill addresses problems arising from the e.p.a.'s mercury and air toxins standards and the cross-state r pollution rule, known as caspr. under caspr, we're requesting that the status quo remains in place for sulfur dioxide emissions. due to the nature of the coal, these facilities would be unable to comply with a new standard that is expected in 2017. under the mercury and air toxins standards rule, we are proposing to hold the industry to alternative limits to lied row jen chloride or sulfur dioxide emissions. consistent to this legs, two senators recently offered an amendment in the senate exempting this from both requirements. while this proposal was supported by a bipartisan majority of senators it failed to achieve the supermajority required to pass. this shouldn't be a controversial or partisan issue. we want to hold this industry to high standards, but standards they can actually achieve. y bill will help keep the coal refuse industry in business so that the economy and the environment will continue to reap the benefits. the
