is the epa -- has the epa ever made a mistake? >> i'm quite sure. >> do you think any of those mistakes have led to a job loss? >> i cannot answer that question, we do our best to not make mistakes in the first place. it shows that job loss is not a consequence of environmental rule. >> i just want to make sure that you understand -- i don't think that there is a will in congress to do away with the epa. we hear that a lot. and i don't think that there is a will to do that. but i do think that many of us here recognize that the epa has helped to lead the way for clean air and clean water, but there is reaching a point somewhere in the balance that -- we just want the epa to be more responsible and to be more receptive to the impact that the decisions are having on families. and i think that you are missing the point. two examples with that include the timing of your additional regulations and the second is the use of improper or flawed models that you are using. just touching on the timing issues. there is an adage that we use and

the waters of the united states. again, epa wanted to expand it's authority over the waters of the united states. put forward legislation in 2009. it did not go anywhere because congress and the people did not want you to expand that authority. so through regulatory action you expanded authority. and now you're doing this. and the chairman laid out that you're trying to move through congress, didn't pass okay? that is the way our constitutional system works. but it doesn't work for agencies to say it didn't pass through congress, so i'm going to do it anyway. your agency in my view has been one of the biggest abusers. are you familiar with the regulatory group versus epa decision? >> yes i am. >> did you read that decision? >> yes, i did. >> it was a decision where the supreme court was chastising the epa for taking actions and authority that it clearly said it didn't have. let me read a provision of that recent supreme court decision. epa's interpretation is unreasonable because it would bring about an expansion of the epa's r

i'm told the congress funds the epa internal management of budgets by hundreds of millions of dollars every year. small and rural communities want congress to know that the only benefit the get comes from the small portion of the funding that is directed to on-site technical assistance provided with equal circuit riders. what small communities do when they have a question or water issues call the local circuit rider and that they know and trust that can give them clear answers. the circuit riders often come immediately on-site to small communities and to teach them how to fix the problem. there's no one at the local level providing this a central help. after katrina, two of my small communities were devastated. a third of approximately 2500 people were without power and water. people in communities can get by without power for a while but not without water. i called the mississippi rural water association circuit riders and they have emergency generators for me and delivered them to the communities at no charge. since the circuit riders know everybody in the state, they were able to b
