normally the f.c.c. does a reasonable job in publishing its new rules fairly quickly after adoption, however on more controversial items, the dockets aren't available until much later. the lifeline order adopted on march 31 was not available for 27 days. nearly a month. the f.c.c. should not be delaying publication on controversial items. it should seek to add information rather than appearing to hide the ball. at the same time, we recognize that the f.c.c. must have the ability to respond to dissenting statements that criticize its decisions. accordingly, we worked with our colleagues to ensure the commission had fair opportunity to address dissents and still make sure that new rules became available to the public in a timely way. in other words, so the commission can do its work back and forth among commissioners, finish their product and once they do, they need to make it available to the public. by the way, that's who they work for. i thank my colleagues on the committee and representative ellmers and

what happened was the f.c.c. determined that there was ability to have more channels so in the 1970's they made a transition from a whole group of c.b. radios that had x amount of channels to the new ones. you know what? they announced that as of a certain date, i can't remember, it was like january 1, 1978, that the old ones couldn't be sold anymore. you should have seen the fire sale for the old ones at the consumer electronics show. you could have bought -- the packaging would have cost you more than the profit. we do have to realize we're going to have that. particularly when we look at band width. because we're going to reallocate some band width today to more mundane things. i'm ct, you know, today, looking forward to 28 gigahertz communication, something satellites are doing, being used terrestrially. just to give you perspective, when i came to congress, the idea that we would be using five gigahertz hadn't yet come out. when i was a kid, even when i was an adult, we only thing we could be gigahertz used f

peter: finally, is it cumbersome to come up with the rules and regulations that the f.c.c. does under a 1996 congressional act? michael: your question is important. i leave the legislating to the congress they determine the best time to update the law. they have expressed in updating the statute since 1996. i leave it in their capable hands. the calendar has gotten away from them. but there is appetite to change some of the statute. i do find that the statute does provide a number of problems for the commission. we are taking advantage, the majority is, taking advantage of provisions in the statute interpreting them in ways that weren't intended, reading words in or out that should not be done. so i have trouble with how the commission is interpreting the law and whether they are actually following the law. i don't believe they do and i have expressed my views on that point. beyond that, i do think that modernizing the statute would be appropriate, but that's for congress to decide. peter: michaela llo riley, one of two republicans on the commission. and howard buskirk.
