someone that respects and loves the fbi. one hand, you can understand why andrew mccabe will be upset about the way he's treating. a lot of people are saying this is someone that appeared to have misled investigators, leading the hillary clinton e-mail investigation under questioning circumstances, took a long time to recuse himself and maybe tonight accountability is finally coming. >> and i can understand those voices. look, i think as always, the devil is in the details. i want to read that i.g. report as well. i want to see the strength of their case and under what are we really talking about here. is it some supposition that he was less than forth right or did he lie and they have proof of those lies? those are two distinctly different things. if it's the latter, the fbi that i knew acted under the longstanding expectation and this went pack before louis freeh, when louis installed what was known as the bright line policy. if one of the two bright lines that if you were to cross, one was lack of cantor, you were to be f

especially at the top levels of the fbi. the executive ranks of the fbi. they're setting the example for the street agents out there. i'm telling you, in my tenure in the fbi in 25 years, i've seen many street agents fired for lying during an investigation of a relatively minor infraction. the deputy director makes those decisions often. >> harris: so it would be from what you're saying maybe not enough to fire andrew mccabe before his pension kicked in. if you have seen others fires for less, what do you think about accountability for this specific case? >> well, if -- i'm going to underscore if -- the inspector general has facts that support the premise that he lied, then it should be a firing offense. it is a firing offense almost 100% of the time with lower level street agents and agents in general. this is the top of the fbi. mccabe will never have to testify in court, but an agent that lies is worthless in court. if it's in their background, it has to be disclosed to the defense. so you know, that example has to be set at the highest levels of the fbi

the fbi then closed the case. then on january the 5th, this year, the fbi received a call from the shooter who knew the woman well, and she described a troubling young man who posted pictures of mutilated animals and guns on social media, and the shooter described the shooter as homicidal with homicidal ideals. and then gave the names to four people in his social immediamed accounts saying quote, i want to the kill people, end quote. and the caller also expressed her concern that he may try to get into a school and shoot the place up, end quote. the call-taker concluded that there was no imminent threat because the tip did not protect a target date, and if the fbi had followed oun that tip, it would most likely have sent agents to interview the shooter. either way, it appears that the fbi did not communicate about local law enforcement, and to have a responsible for this as well, and on the 18th, the florida department of family opened up an investigation about the shooter, and at that point, the department of fam

i know that he feels deeply about the mission of the fbi. i know he has the support of the rank and file at the fbi. and this is no way that he should be treated. >> i know when james comey told congress that the president asked him to let go of the fbi's flynn investigation, you tweeted that trump was inappropriately prying into fbi investigations. so here we are a year later, nearly. what's your take? do you think the president had any direct influence over his a.g., jeff sessions' decision? >> well i think that the attorney general did the right thing in setting up mr. mueller in the special counsel. and i guess recusing himself, mr. rosenstein actually appointed mr. mueller. but mr. sessions, the attorney general, did the right thing when he said that he had a conflict and under the rules of the department of justice, he could not be involved in the russian investigation. i think he stayed out of the russian investigation. and mr. rosenstein has been the principal person in regards to those decisions. that's how it should be. >> with rega

we count on the fbi and the fbi can be counted on. mr. mueller is a republican who is conducting an investigation and i think the way that the public is going to have to deal with what you are describing is to be patient because he's moving very deliberately. he's got guilty pleas already, he's gotten indictments, there's -- there's something there to investigate, whether or not it leads to obstruction of justice charge against the president or money laundering or collusion, we don't know, the investigation is not over yet. kelly: to your point deputy attorney general rod rosenstein stating that a week ago says that he sees no reason to stop the mueller investigation, yet we have this morning the attorney for the president john dowd saying he should stop this now in the wake of what's happening with mccabe, is that the right thing to do at this point? isn't that taking to political status? >> it is because the two aren't directly related, yeah, there's a little bit of overlap because mccabe may be called to testify in mueller information.

levels of the fbi. mccabe is saying in his own right that he was being targeted by the president. that his comments about the ongoing mueller investigation were the real reason why he was targeted for investigation and then subsequently fired. there's a question now about whether mccabe is going to pursue some kind of legal recourse to receive his pension. and in that process use the president's own statements, his comments on social media, the constant pressure on jeff sessions to justify his claim that he was being unfairly targeted. on this issue, there seem to be a claim is being made on both sides and i will say that when this inspector general report actually comes out, we will know more about what mccabe was actually accused of doing. but for now, it seems that the trump administration has moved forward to fire mccabe and remove his pension at a moment when at the very last possible moment he stands to lose, you know, perhaps over a million dollars in retirement funds as a result of this decision
