tell us about the situation in massachusetts. as the time put stress on the availability and the distribution of pharmaceuticals in massachusetts? guest: that is an excellent question. one place where we have seen the growth level out as the cost of prescription drugs. before health reform, many of the insurers and the state actually took measures to try to encourage people to use lower- cost drugs that are just as effective as the most expensive ones, and therefore, the rate of growth of prescription drug cost in massachusetts has been relatively small, relative to the cost of other parts of the health-care system, and also relative to what is happening in other parts of the united states. prescription drug coverage is one of the benefits that the connector board required as a part of minimal credible coverage, and that is a minimal standard for which individuals need to show that have coverage. hopefully, in this day and age no one believes that prescription drugs are not an important part of coverage. my belief is that by manda

we are a nation of laws, not of men, the famous phrase from the massachusetts constitution. we are governed by the laws that congress enacted, not by what they intended when they adopted those words. the only way to remain that government of laws is to interpret laws on the basis of what they say, and not on the basis of what we think they meant. we can imagine a lot of things, what we think congress had in mind. i did want to say that -- we have some members of the press over there. i am sure they are very upset to learn that the freedom of this press depends on this due process clause. i thought you could not take away the freedom of speech or the freedom of the press, even with due process of law. those rights are guaranteed in the first amendment's. you cannot take them away. that does not mean that freedom and liberty means freedom of speech and freedom of the press. the first amendment says congress shall make no law abridging freedom of speech. says nothing about california. the reason it applies to california is because it has been applied to the word liberty in the d

it's also the criticism of the massachusetts law. the coverage requirements came first, the cost requirements will be the things we will continue to struggle with overtime. there are few things that help. one of those we considered it important is it allows employers to provide stronger incentives for participating in employer- sponsored well as programs. all right now, under regulations, you can only very premiums are cost sharing by as much as 20%. in wellness programs, it gives a little more flexibility, allowing for a variation of up to 30%. i mentioned briefly there is comparative effectiveness research that will be underway very shortly. a new infusion of funding for that purpose in the legislation and there is a new quality measures for performance of health-care providers and services already used in medicare now, but will be increased under the legislation. that is important because while it only apply it to medicare, they are the 800 pound gorilla, the biggest player in the system. some of those practices are likely to be pi
