planning to cut a third of their budget, yet their caseloads are already at twice the number of the national standards permit, so you have got that kind of economic pressure. there is also another type of pressure that comes from the lack of professional independence, the way we structure our public defense, especially our contract systems. when i was doing research for the commission, i interviewed the public defender's office, and they were brought into the office. they were not elected. they were selected by the chief operating officer, whose main bottom line is economics, not justice, and they said, this is the budget you are going to be given. you either do the job with that budget, or we get someone else. are you willing to take the job? that was the condition and made bluntly. i happened to be on the panel. everybody was talking about stakeholders and how we wanted a team player. i think the culture makes the player. now you hire somebody that is going to be a team player. we need independents. i am not sure i would go with the reelection everywhere. in san francisco, you have got an intelligen

that mean we would not need these other remedies, but we are a long way off from that being the national standard, unfortunately. what i work with people on every day as cleaning their records up to the extent allowable under california law, so cleaning your record up to the extent allowable under california state law is really different from saying "clean slate." i feel like we are at best raising expectations unfairly because there is no clean slate in california, but we are trying to improve the laws that there are and expand them. actually, this session and assembly -- my coworker who works on policy in my office has been successful in working with community partners and putting forward ab 2068, and it is really a technical fix, not sending terribly exciting, and if i say it, your eyeballs will fall out of your head, but it basically updates penal code section 1204a the expunge men or dismissal remedy, and brings it up to the same level as 120 3.4. the point is in some cases, people who can get that a remedy for cases when they did not go to prison, there will be eligible to legally say -- so

the national standard promulgated by goals states there should be one investigator for every three attorneys. we found that most offices in this state don't comply with that. they don't meets that requirement. some had as many as nine attorneys to one investigator. that problem is coming pounded by the fact that attorneys also are overloaded. more than three out of four public defender offices reported excessive attorney caseloads were a significant problem in their office. you have a multiplirefect. if there are mot enough hours in the day to investigate the cases obviously some soft cases don't get investigated. that's the problem that we're seeing. now other problem of course deals with well, why is that situation? public defenders represent the lion's share of all of the cases. yet what we see, you would expect them to have rough parity with the prosecutor's office. we don't see that. what we see statewide is for every dollar spent on prosecution only 53 cents is spent on average for the indigent accused. yet in some counties as much as 95% of all the cases involve indigent defendants. c
