the issues behind them. tonight, lochner v. new york, 1905. it is one of the controversial cases of the supreme court, and in fact the story of a banker from new york whose case gave rise to an era that defined supreme court cases for the next 30 years. let me introduce you to our two guests who would tell us more about this important case. randy barnett is that georgetown law school and is the author of a book, restoring the lost constitution, the presumption of liberty. think you for being with us. paul kens wrote the book on lochner, he wrote a book called lochner v. new york. his homebase is university of -- texas state university. why is this case important? >> the case has become a symbol, a political symbol and it was made into a political symbol by teddy roosevelt when he ran for president in 1912 and it was a symbol about how roosevelt claimed that the court had overreached and overstepped its bounds to block progressive legislation from being enacted at the state level, and ever since then it has been a political flashpoint because it

new york. look -- you showed "the daily news" headline, take the you know what train -- >> two subway lines -- >> and -- this is new york is so in your face. we cannot from wisconsin nice to new york nasty. and you know, he has -- ted cruz learned that in the bronx, a jeer is a jeer. and he went through the hazing ritual over the tabloid headline. but yes, this is all being pumped up. his goal still if he can keep trump to under 50, i think that's going to be tough. that's what counts as victory. >> the "boston globe" today has this mock front page put out in the opinion section. we can put it up on the screen. "deportations to begin," this imagines we're already in a trump presidency. "markets sink as trade war looms. new libel law target the "absolutely sdmum pre" absolutely scum in press." does this go too far? >> certainly trump voters, if this was intended to reach trump voters, are going to view it as crossing the line from providing information to advocacy. and they may also be offended and think that they're talking down to them with some of the specifics that were in there. at the same

that touch new york city. the democrats give out their delegates proportionally by congressional district. we got a pretty good sense out of new york city what the breakdown will look like there. hillary clinton had a big night in new york city. she'll probably net roughly, roughly, this is an estimate, she will roughly net 20 delegates from the 12 districts that touch new york city. the rest of the state, you see, it's more of a patchwork. we have limited returns from some places. but if these basic dimensions hold, as the rest of the state comes in, i think we can expect hillary clinton would end up adding over 30 delegates to her lead over bernie sanders. again, that's very rough right now, because we still have to see some of this vote come in up here. but the bottom line is that 210 is going to end tonight bigger, potentially, significantly bigger than it was. we went through earlier. how hard it is to erase an advantage that size for bernie sanders. it just got a whole heck of a lot harder. there's people wh

new york? >> not at all. new york is not a unified state the way other states are. there are groups in western new york, northeastern new york and of course new york city which is dominated by a liberal media. it's not the same. there's not an all powerful radio talk show or host that could really affect the outcome. >> turning to the democrats, and i want to go to you on this, bob, new york one and cnn are co-hosting the debate. this time last week we were asking was there going to be a debate. eventually clinton and sanders did agree. what can we expect on thursday night? >> there has been a high yat tuss on the debate and i think there's anticipation of that. on top of the idea that brooklyn is the centerpiece of this debate, it's not just some warehouse in the middle of nowhere. this is in the middle of clinton's headquarters is based and where bernie sanders was born. he's a brooklyn native. so you have that template as well. >> full disclosure, my wife works at new york one so we're sort of in the family. new york one as new york's 24 hour cable news channel, h

new york. he's trying to make the case to conservatives in places like western new york. did you notice that? d, people in western new york, they get what i'm talking about. the same argument he made against donald trump months ago. pennsylvania is another place he wants to compete. the campaign season is the second phase in his strategy. cruz has been able to show with wins in iowa and utah that he can bring together the evangelical vote, the social conservative vote. they need to show that they can pick up moderate and someone conservatives and bring together the 50% of the republican party -- 60% of the ruble can party that want to stop donald trump. john: his campaign is well organized. the congressional districts in this state with the highest education level, therefore less prone to the trump message, or around the five boroughs. these are not particularly hospitable areas for ted cruz. what does he do to unlock the democratic and geographic riddle that is new york? >> first, acknowledging that this is a bumpy road for ted cruz. i don't think the campaign thinks they will beat donald tru

it really was an easy call for the new york post and for some of the other new york papers that have sed donald trump. ted cruz essentially disqualified himself as a candidate in the state of new york when he ran earlier in the race and never expected new york to matter, assumed he would sweep all the southern states, get the delegates he needed in the deep south, and new york would be an afterthought, and california. he made that remark at the debate like he's in a 1980s commercial where he was attacking new york values. well, you can go ahead and do that, but if new york matters, there are koconsequences, these are the consequences, and the newspapers didn't have a choice. >> the poll was a national poll from fox news which is pretty interesting in itself when you put that back up. it shows donald trump in front and ted cruz in second, john kasich in third. but if we can see it, there you go. it shows that ted cruz has slipped in the fox news poll since march despite all the victories that he's claiming in the last several contests, his national numbers have gone down. john kasich's
