chair of the local republican board today told the big state board they were dropping that idea. it, please, can we let this go? the state board did vote to stop the early voting at appalachian state. they did say today they're open to bringing it back. for appalachian state, watauga county, no 9,000-person precinct and the no has been walked back to a maybe. we're covering one other story in north carolina with bigger implication and a big surprising development in that story as well. a couple weeks ago you recall we took this show to elizabeth city, north carolina, to cover the story of this young man named montraviuos king trying to run for city council in elizabeth city. he's a student at elizabeth city state university which is the locally historically black college. the chairman of the local county republican party has been challenging voters from that school. he got dozens of them purged off the voter rolls in april. then last month, he challenged the right of montravious king to run for city council in elizabeth city. he said because mr. king lived at school he couldn't be

the state's attorney general that the teachers are relying on a law that's not intended for them. he says that law is for private security companies only. it effects 13 school districts in arkansas. the state boardes ruled today that those districts can continue using their licenses for two more years, but that it will not accept any more applications. arkansas state law prohibits guns on any campus but licensed security guards are an exception. something very uncommon has happened in colorado. voters last night kicked not one but two state lawmakers out of office in the state's first such recall election. here are the two ousted lawmakers. both democrats, they recently voted for stricter gun laws. shortly after the school massacre in aurora, colorado. but, grass roots activists, it says here and the national rifle association, claim the lawmakers' votes violated second amendment rights. that led to this recall vote. political groups $2 million on ad campaigns. now the voters have spoken. two republicans who had opposed tougher gun restrictions have replaced those two democratic lawmakers. of course, gun rights activists are claiming a big victory and alicia acuna has the news live on a rainy ni

the district of columbia. and there was a big fight between the board and the united states government representing the board arguing these were valid recess appointments because the senate really was in recess despite the pro forma sessions. and the company said the pro forma sessions count. and everyone anticipated there would be a decision by the d.c. circuit on the question of whether this pro formas are enough of a session to present the conclusion that there is a recess that allow it is president to make these appointments. the decision comes out and the court goes way beyond the question. in fact, doesn't even address that question. it addresses two much more fundamental questions about the scope of this power that has been around since the beginning of the republic. and the first is what does the recess mean. remember i said vacancies that may happen during the recess. the court said the recess that's phrased in the singular so must apply to only one recess and if there is only one it can apply to, it must be the recess between the sessions of congress. the recess between the first session and second session
