there's an area that that some employee of the tsa thinks is not secure. so that's the information.en the information comes out that there's this problem with that particular airport and the tsa employee thinks that it's not being remedied, so this person wants to disclose it. now, how would that this information has to be disclosed to a certain number of people associated with that airport in order for the problem to be remedied. so how would that be dealt with in an executive order? the president has to issue an executive order about that specific thing and say, this can be disclosed to security people at the airport, the local police, maintenance people who are going to fix that. how would you deal how would that be dealt with? >> two different ways. one is through the classification regime. the other, as we've been talking about with justice breyer, is through the nonclassified ssi system. the president can pick up the ssi system, in general, under the exemption because it does deal with national defense and foreign affairs. there are parts of ssi which may not fall within it, b

and then the tsa put in body scanners after the attempted underwear bomber. when this bomb maker came on the radar, some international travelers had to turn on their phones at security to make sure they were actual phones. how do you think the tsa is going to react to this or should react to this? is there anything more preventive that should be done? >> well, the measures, more than likely, would continue. as you rightly point out, there are others out there. for example, there's a norwegian citizen who is also known to be in that same category to have been trained by al qaeda's best bomb making skills and technicians. so it becomes a case of this cat and mouse game, intelligence operation, law enforcement cooperations and sharing information and vital bits of pieces of information to put that mosaic together as to what their intentions, targets, and capabilities are. so that will continue. >> airports are the last line of defense for plots like this. how confident are you that airports in istanbul and doha and hamburg are ready? >> that's a really good poin

i think the tsa, if you're on the no fly list, i think you should have a right to be heard. there should be rights of redress there and to be challenged your being on that list. i think there some of the phipps make a lot of sense. some of the phipps like security make sense. others might not. but i think the larger component of all this is that there's adequate control and accountability which is also part of the phipps. so that everything within the phipps, such as individualized notice of everything that's collected is not really feasible. there is a greater transparency right in the phipps, too. not that individuals get notified of every collection about them, but that there is a public accountability and generalized exposure about what's going on. >> i thought that the acknowledgment in the nsa report that some of the phipps principles couldn't be fully implemented in the context of a national security surveillance program was an absolutely accurate reality. you can't provide an error correction in all notices. i was talking more about the secondary screening on the no
