let's bring in chief congressional correspondent for the washington examiner. overnment is partially shut down. the question is, how long is it going to last? any ideas? >> it will last as long as the president and chuck schumer cannot agree on a price. and that price is for border security and whether or not chuck schumer will allow any of that money to be used to build a physical structure on the border, something that can be called a wall or the steel slats that the president is talking about, some kind of structure. until they can come to that agreement, at the very least, an amount can vary at this point, i think the president's flexible, but until democrats at least agree to budge a little bit on that, the government's not going to reopen. this partial closure won't end. jon: we know the earliest things could get back to normal would be december 27th. democrats are suggesting that it might go on into january when they take over the house on the 3rd of january. why does that give them more leverage? >> i don't know that it actually does give them more lever

byron york the chief political correspondent for the "washington examiner," mara eliasson and katie pavlich a weird day and a bad day for michael flynn, he goes into court thinking it was a formality, the prosecutor has recommended no time in jail for him, have a little meeting, say you are guilty again, walk out in no time in prison, move on with your life. the judge had raised this question over whether he had committed treason which is outrageous especially coming from a federal judge on the bench, he suggested flynn had sold out his country and he was on unregistered foreign agent inside the white house which he was not. >> bret: wasn't he talking about the allegations about the ties to turkey? >> the judge can bring up uncharged conduct in a sentencing case but to suggest he was an unregistered foreign agent in the white house, the prosecutor corrected the judge saying that had ended before. by the end of the day it was a weird situation in which all of these things had been raised, it's the craziness of the whole trump debate moved into the court room for a day and michael flynn futur

saying when "vogue" and social media chime in on this, that's different when the "times" or the "washington examiner." when you use they to cast a big umbrella. we just have a minute here for you. the headlines were pretty disturbing. let's bring in our panel, byron york is the chief political correspondent of the "washington examiner." i may interrupt you if i see senator schumer and the minority leader nancy pelosi. your thoughts as this developed today include the president -- it happened fast. >> we saw a whole bunch of stories that he was caving and he was going to agree to this, we had a lot of criticism of him by rush limbaugh and ann coulter, paul ryan and kevin mccarthy go over to the white house and he is not going to sign this bill that the senate has passed. one interesting thing here, in this procedural vote that he was reporting about he said they had 400 votes which means that republicans have gotten a lot of their members back in washington. i think they had 217 votes in that boat and they believe they can pass this. they were quite affected by these predictions from nancy pelosi and you just heard chuck schumer predicting it as well, they were affected by these democratic projections they didn't have the votes in the house and i think they are trying to say we do. >> bret: here is schumer earlier a
