here's video that we shot 13 minutes ago and you can see here is the train at the west oakland bart station they said 4:00 and then they said 5:00 but then finally at 547, the train operator said i got word. i'm leaving west oakland station into san francisco. so you heard it first on the kron4 morning news. we can back live now and show you a live shot with our cam to show you people are on the platform waiting for the next train to arrive so that's good news. yes it's late. when people got here it was still close there were just basically yelling through the gates to the ticket agents are you going to open. we heard it was supposed to open the four. he said i don't know and then he told us at 5:00 we brought it to alive when he raised the gates that the trains were now running and then people got here. there were so happy honking clapping and then they got to the bart platform only to see the trend still stuck there in the train operator outside with a thousand miles a year on his face. he told me personally i can't leave this location because even if i leave west oakland and means nothin

we have kron 4 will tran at the west oakland bart station. expected to see people showing up smiling but that is not the case. >> we were not the only ones expecting this. this has not been the case because behind made the lights are on at this station and there is a ticket agent but the date is still down. a few minutes ago i saw about four passengers looking through the gate tried to yell out questions but the ticket agents came down and confirmed that they are still confused. they believe that the lines are up but until they get the offical word to raise the date they have to leave it down. they are not want to lift the gates so for now they're still shut down. in the meantime, bart has chartered buse they have a few people waiting for the next bus to come. it has been a very slow as far as getting bart service up and running. in the meantime i had a chance to talk to some of the passengers. here is their reactions. >> i was out here at 3:30 a.m. in this line. then someone came out and told me that they should be running a limited. nobody

we give you a look at the west oakland station even though no deal has been reached. e threat of a strike still looms. "today in the bay's" christie smith is live at the west oakland b.a.r.t. station. an all too familiar story for riders getting tired of it. >> good morning to you, jon. it is such a familiar story. i feel like a broken record telling it over and over again. as you said, strike averted, trains are rolling again. i just heard one pull into the west oakland station. commuters are frustrated. they want to know why it keeps happening like this. it seems like both sides keep talking but they just can't seem to reach a deal. sola so last night talks broke off between 1:00 in the morning. among those walking out was b.a.r.t.'s general manager. they talked for about 12 hours, overnight, both sides. 17 hours the night before. a federal mediator got both sides to stay at the table. there is now a gag order in place. the few details coming out but all sides including that mediator saying that there is progress happening. for the 4,000 riders that rely on b.a.r.t.

the tube. what you're about to see is the oakland west station. out 40 people were on that train at about the time the fire occurred they all rushed to if front of the six car train. ambulances were called to the oakland west station and an emergency rescue train was immediately dispatched from the san francisco side of the tube. the passengers then had too -- had to sit on the train for about 30 minutes to get help. there they were put on to another train that had been sent to pick them up and brought to the west oakland station. >> it did appear that anyone panicked or were about to panic. >> seemed like as people were moving forward people were a bit concerned about panicking, yes. >> i was in the back car when it exploded and the first thing i saw was an explosion. the first one was an explosion. a big explosion. the second was an explosion and fire. it was, wow i can't describe it. you know. >> which were you on? >> the very hraáes car, -- the very last car. >> reporter: you're looking at some of the passengers that were on the b.a. r.t. train

we had a chance to talk to some bart riders were hustling to the west oakland bart station permit hustling get on their trains. but before they hop on here's what one man had to tell me about the ongoing negotiations. >> i think it's a lot of greed is going on behind the talks. now everyone is in limbo at this time. depending on how you felt a list of the budget and will resume at 10:00 this morning. >>darya: making matters worse the ac transit union up announcing plans that it is going to strike tomorrow if there's no deal reached. that's i 12013 were talking tomorrow during the commute this could be an issue. union drivers and mechanics and dispatchers had issued a 72 hour strike notice. that would take effect at 1201 tomorrow morning. 72 hours as of tomorrow morning. trans officials say a strike will be catastrophic and as the governor to step and and issue a cooling off period to keep those trains running. >> are members do have the right to strike. that would have stood down a 60 days and negotiate about a bit of a complex. whatever to george raft. at his in the traffic department is
