today in the bay's thom jensen has been live out there all morning. ts? what are you seeing now? >> reporter: you can see that, you know, they moved those people out. they did arrest seven people, they were detained by police. they were all charged with trespassing, and two people were also charged with failing to disperse. all misdemeanors taken to the north county jail in oakland where they will be processed and likely released at that point. this work has been going on all day. you can see the moving containers that they are bringing in here, stacking two deep to keep people out once they got everybody out. take a look at the video they got overnight showing crews moving in and tearing down structures. there was a tree -- the trees that were going to be taken down are now down. police and chp officers barricaded every street within two blocks from people's park. several clusters of protesters that oppose the university building a housing park have been showing up and clashing with police and workers at time. you can see police physically going into

"today in the bay"'s thom jensen is live in the east bay. f people in the community are expected to turn out for what's expected to be, understandably, an emotional vigil. >> reporter: should be very emotional. good morning to both of you. yes, in oakland's chinatown at 10:00 a.m. today, hundreds of people are expected for this vigil during the daylight hours in oakland in chinatown, in an area where he spent a lot of time not only on duty, but off duty as well. officer tuan le was born in vietnam in 1987 and he was being remembered and honored as an honored police officer, husband, son and friend, who dedicated his life trying to make oakland safer. colleagues and family say he was always upbeat and brought laughter to everyone around him. hundreds of people from across the country are expected to remember his life and say good-bye at the ceremony this morning. he was the 54th oakland police officer killed in the line of duty. the investigation into his murder is leading to new concerns about how the case will be prosecuted, after two of the

live in berkeley, thom jensen for "today in the bay." >> thank you very much. >>> one of the suspectsn the murder of an oakland police set to appear before a judge later this morning. >> today in the bay's bob redell joins us from the news room. there could be more arrests even still? >> correct. oakland police say this investigation has not ended and it's still ongoing. as you mentioned, there could be more suspects taken into custody. right now three men have been charged in connection with the murder of oakland police officer tuan le who was working outside a cannabis dispensary. two of the three suspects are facing murder charges, including this man, 27-year-old mark sanders of tracy who is accused of shooting and killing officer le. a third man is being charged with burglary. the district attorney, pamela price, says sanders is being charged with the special circumstances and special allegations. interim oakland police chief confirmed one of the suspects was arrested with officer le's handcuffs and that's reports of sanders' violent past is true. >> he has the history of the kill

. >> nbc bay area's thom jensen there a week ago when the officer was gunned down. now, thom, you are at this memorial in chinatown. tell us what's happening. >> reporter: good morning to both of you. what an appropriate place to have this in the heart of chinatown. organizers set up a makeshift temple in this room here, a buddhist temple, and had a ceremony here with chanting and bells that would help, in the buddhist belief, send his spirit into the next life. his memorial began an hour ago at pacific renaissance plaza. he's being remembered as decorated officer, a husband and son who loved oakland. his family and friends and colleagues say he dedicated his working and free time to this community. oakland city councilman noah gallo met him as a teenager. >> he's an individual i've known since high school days. he went to high school with my two daughters. i was there at graduation, handing out diplomas, being on the oakland board of education. i attended his police graduation ceremony, as well. he was a respectable, loveable, young man. >> reporter: officer tuan le

"today in the bay"'s thom jensen is inside -- or outside chevron's richmond refinery where the flaring been an issue before. good morning, thom. >> reporter: good morning. we tried to get inside but they wouldn't have us. you'll remember there was 100 complaints filed here back in late november about a flaring event then. it took workers here at chevron ten hours to fix the problem back then, to stop that flaring back in that late november event. this time it was less severe and there were no complaints, last time the company issued -- self-reported a level 1 air report, but hazmat teams found no health risks associated with this one. chevron said it is used after a disruption to keep the plant operating safely. health officials did not issue an air quality alert this time, but this comes after a series of events like this at east bay refinery, we were just up the road in martinez recently after an event at the refining facility there. count health officials initiated a lengthy surprised inspection there, which followed with a demand letter for some issues that they said they wanted re
