guilty in the murder of officer nick thomas pwuvrjt. vick lee has the story. >> came forward with a verdict based on the fact based on evidence fought just but the citizen that were also a victim of i call it street terror. >> pros can youtor fleming hugged officer nick thomas burke family members outside the courtroom. it has been 4 years since burke was killed. the defendant steven pat was 19 when he plowed his virginia than into the officer patrol car. fatal crash occurred the night of july 26 2006. here at cambridge and fulton streets. he was in the stolen van with two ovrments he led police on high speed car chase after committing a string of robberies. they wound their way from highway 280 through city streets. impact of the crash turned his police cruiser on to the sidewalk. burke had been on the force 5 years at the time he was stationed at bay view police station. fellow officers were lived when they found out that pat was out on bail in the murder happened. >> i will find out why this piece of garbage was not incarcerated. >>reporter:

building to be sure he didn't leave anything outside when he came in. >> as we heard pierre thomas allude to, that mr. lee had just come off a probation for the 2008 disturbance outside of the building of discovery. there were so many red flags. anything more that could have been done to prevent this from happening, chief? >> i'm not sure that there would have been. i think the folks at discovery had prepared very well for any type of emergency situation. their security was aware of mr. lee. he -- they, of course, had not seen him for a couple of years. but they were aware of him. in fact, immediately, when he came in, very quickly identified that he was the individual who was involved in this incident. >> and how did your officers come to the decision to ultimately take him down? >> in this situation, the hostages who were tremendously courageous throughout this incident, were in grave danger. we had s.w.a.t. officers that were very close by, unbeknownst to the suspect. s.w.a.t. officers heard a shout. they heard a pop. they were unclear if that was a gunshot or if it was the suspect detonating a device.

lee is shot. killed in an instant. for "good morning america," pierre thomas, abc news, washington. >>> and joining me now from washington are jim mcnolte and chris wood, co-workers that pulled off their own remarkable escape. it's so good to see you this morning. thanks to you both. jim, let me begin. it was a confusing scene when you walked into the lobby. didn't know what to make of the gunman at first. then, he asked to speak to you? >> yes. after i was laying on the floor for a while, he said, you, in the glasses, stand up. i stood up, with my hands up. what do you do? i didn't want to tell him i was a producer. so, i told him i was in schedule. >> why didn't you want to tell him you were a produce center. >> just the way he was going on and on. it just seemed like, i didn't want to become part of what his problem was. so, i just thought if i came up with something innocuous, he would leave me alone. >> he also asked you about your children? >> he did. he had been saying that humans were the filthiest animals on the planet. and the planet didn't need kids. he said do you have kids? yes, sir, i have two. who told you

thomas major. good to have you with us this morning. as we heard and saw from wyatt there, james lee had a history with discovery channel. he was arrested in 2008, charged with disorderly conduct and ordered to stay 500 feet away from that building. when you got this call then, did you have a good idea of the man you would be dealing with? >> well, we very quickly got that information from the security folks at discovery. discovery was aware of the threats that -- history with this man. the security guards working at discovery, i think still had the information, including a picture of mr. lee at their disposal. we were very quickly aware of who we were dealing with. >> this is an incredibly scary situation, obviously. especially for the folks involved. two employees and a security guard held hostage. they were able to evacuate the building. even after the suspect was killed, as you are looking at two boxes, a couple of bags, thinking that there could be explosives, at what point did you know, though, that, in fact, everyone was safe? >> well, it took a while. the -- when the suspect
