i'm frances rivera in for thomas roberts and we have been watching breaking news coverage here on msnbc the past half hour. stunning revelations coming out of federal court there. jared fogle, the former spokesman for the sandwich chain subway, again, agreeing to plead guilty today to possessing and distributing child pornography and traveling to the city of new york to pay for sex with minors. court documents reveal these allegations involving at least 14 minors and fogle is accused of engaging in sexual acts with at least one of them. in that stunning news conference that just wrapped up, federal prosecutors say fogle used his affluence to prey on children. >> today jared fogle has been charged and has admitted to participating in a five-year criminal scheme to exploit children. this is about using wealth, status and secrecy to illegally exploit children. >> and fogle's attorney says his client will work to make things right with his victim. >> he knows restitution can't undo the damage that he's done, but he will do all in his power to try to make it right. jared also knows that he h

i'm francis rivera in for thomas roberts. only ten roses to give. sometime after 5:00 p.m. today the major republican candidates for president will find out which ten will make the main stage for the party's first debate on thursday. fox news hosts the first debate and based on their criteria nbc news estimates that these are the ten who will make it. filling out the outer edges of the debate platform are two governor new jersey's chris christie and ohio's john kasich. out of the main debate is a former governor texas rick perry. however, there could still be room for a 11th candidate to sneak in. last night 14 of the candidates made an attempt to break out from the pact. this time in new hampshire. they talked hillary clinton, president obama, budgets and terror. the one topic that kept coming up, i'm graksmmigration reform. >> in the 2 1st century legal immigration must be based on merit. >> the border needs to be secure expanded guest worker programs. >> i don't think this administration is serious about border security or protecting working men and women. >> i think we

i'm thomas roberts live in los angeles.s in the aurora movie theater shooting trial. the jury reaching a verdict in the second phase of the penalty portion for james holmes. we expect the verdict read in about half an hour from now. the same jurors that decided the guilt of holmes and they have to decide whether or not to keep the death penalty as an option for holmes who killed 12 people and injured dozens more three years ago at a midnight showing of "the dark knight." joining me is scott cohen from colorado and paul henderson. but let's go straight to the scene with scott. bring us up to speed, the latest and are we still on time for that 2:30 verdict announcement? >> reporter: yes, all indications are we are on time and will get the verdict in about a half hour from now. this is a complyicated situation. we all know what about unanimous jury verdicts and deliberating trying to get a 12-0 verdict but in this case in terms of colorado law, it actually says in the jury instructions that they received on thursday that this

robert e. lee and says, take from this whatever you need. thomas graves writes that he goes to the confederate home of robert e lee on franklin street. he knocks on the door and fitz hugh lee answers the door. he's the nephew of robert e lee a brigadier general, and a classmate of godfrey weitzel. not the same class, but they were contemporaries. graves announces he is here from weitzel to tell lee to take what he needs. fitz hugh lee is touched by this that he has to walk across the room to regain his composure. lee speaks to his nephew, and the nephew comes back to the aid and says, "send general weitzel our love. tell him thank you, but we don't need the money. we would like safe passage for the lee women who need to come back to richmond." weitzel grants safe passage, and the lee women are back in the home within the day. the same day in washington, lincoln decides to go see a play. it has been a tough week for him. it's been a tough four years. as he sits in the booth watching the play, the president is assassinated by john wilkes booth. weitz
