tim johns, abc seven news. >> all right, tim, thank you so much. we move now to developing news out of georgia, where a 14 year old student is in custody accused of opening fire at his high school, killing two students and two teachers. the shooting sent students scrambling for shelter as officers swarmed the campus of apalachee high school outside atlanta. cell phone video shows some of the students as they were being led out of the school. at least nine other people have been taken to hospitals with injuries. investigators say two school resource officers encountered the suspect within minutes and he immediately surrendered. some of the students made frantic calls to family members as the shooting unfolded. >> i said, son, please tell me you're joking. he said, no, mom, i'm not joking. he said, they shooting and they shooting in the school and the shooter is right across the hall from me. >> the teachers came in and they were like, everybody get on the floor. cover yourselves. like we were all, like, hugging each other. >> investigators say the t

tim johns, abc seven news. >> all right, tim, thank you so much. a fremont fremont man is being held without bond after he was arrested for assaulting flight attendants on a frontier airlines flight. the plane was headed for sfo monday. here's a live picture of that airport. it was about four hours late, departing from john wayne airport in santa ana. the flight was then diverted to ontario international airport in san bernardino county. according to court paperwork, the diversion was because a 30 year old fremont man tried to choke one flight attendant, pushed another and kicked one about six times in the leg, leaving visible bruises. the justice department says this all happened after he pulled down an oxygen mask from the overhead compartment and started yelling obscenities. the suspect faces federal charges of interfering with flight crew members and attendants. he is due to be arraigned on october 1st. >> new developments on the future of the oakland a's. there is a report out tonight that the deal to bring the team to west sacramento next sea

let's go live now to abc seven news reporter tim johns. he's at the da's office where these charges were just announced. tim >> yeah. dan, we heard from district attorney brooke jenkins literally just minutes ago here outside her office. she, of course, says that she understands the severity and the very public nature of this case. she says she has officially filed charges against the person accused of shooting pearsall on saturday. let me break down some of what those charges are for you guys. the first one, of course, attempted murder with the allegations of intentional discharge of a firearm and the personal use of a firearm. a second charge assault with an automatic firearm and the final charge. the da says she is filing attempted second degree robbery. >> at this time, the charges will be filed in the juvenile court, no longer under california law. can a district attorney choose to file those charges against a minor in adult court. the only mechanism for that is to request a transfer hearing, which requires that a judge rule on the min

tim johns, abc seven news. >> all right, tim, thank you so much.he driver arrested for a wrong-way crash that killed a mother and son in the south bay has been arraigned on murder charges. duncan mccrary could barely be seen behind his attorney. he appeared to be in a wheelchair. during today's hearing in san jose, he's charged with two counts of murder. investigators say mccrary was driving more than 100mph in the wrong direction on highway 85, when his truck smashed into an oncoming car back on august 26th. 47 year old rebecca olson and her 14 year old son charlie, both died in the collision. >> at one point, the defendant stopped his car and got out and walked around in the middle of the traffic. he then got back into his vehicle and continued to drive the wrong way. >> mccrary was also injured in the crash. he was released from the hospital last night and is being held in the santa clara county jail without bail. he's expected back in court on november 7th. >> an update now in the murder case of a prominent tech executive, prosecutors say nima
