joining me now is lynn county sheriff tim mueller from albany, oregon.heriff, thanks for being with us. >> glad to be here, you're honor. >> now, sheriff, you took an oath to support the constitution of the united states as well as an oath to enforce and follow the laws of the land. you've made a very interesting statement that if some of these federal proposals come to oregon or are passed in congress that you will not enforce them and you will instruct your dew points to not enforce them. how do you justify that? >> well, i justify it pretty easily because as a county sheriff or any local police officer or any sheriff that knows their business will tell you that he we don't have to enforce federal law. as a matter of fact, we're prohibited from enforcing most federal laws, so there is a separation of powers and you know, i don't have to and we won't. >> well, an interestingly enough, even the federal immigration laws, and yet there is this -- this movement on the part of washington to restrict, you know, the size of clips, the kind of assault rifles th

sheriff tim mueller -- or executive orders by the president. in his letter, sheriff mueller says i refuse to part palt or stand idly by while my citizens are turned into criminals by the unguided actions of politicians. sheriff mueller, i think you have gotten a lot of attention by this letter you sent to the president. explain to us why you feel that you should not enforce a law that you would legally be obligated to enforce if it came down to that. >> well, actually, i'm not legally obligated nor required to enforce federal law. you can take the federal immigration law as a good example of sheriffs and local law enforcement around the country are not required nor are they supposed to enforce those types of laws. so it is a separation of power, and it's my position that the linn county sheriff's office that myself or my deputies, that we enforce that regulation. >> you don't have to enforce a federal law, so what is the point of writing the vice president about this, haven't you stripped away your own power by automatically saying that. >> wha

many sheriffs are now calling for action, like lynn county oregon sheriff tim mueller. have you here today. >> good morning, martha. martha: talk to me a little bit about your process of thinking this through. when you started to hear about the executive orders coming down from the president, what kind of action did you take? what became your plan, and how do you back up your ability to carry that out? >> well, when -- how it first started was is i had a lot of folks in my county asking myself and my deputies, you know, what my position was on if any, what they term far reaching or overreaching gun control laws were established from the feds. i made my position known. i told my deputies that i didn't support anything -- any regulations that would infringe upon the constitutional rights of our citizens. and more and more questions came out, as far as, you know, what my position was. i didn't see really a lot of information coming out of the committee that vice president biden was sitting on, and so i just wanted to reach out to my own citizens in my county and let them k
