joining me now, tim o'brien, senior executive editor for bloomberg. statement from donald trump's team they have vowed to continue appealing this case. what else can happen here? >> there are two options. i would say the odds of either of them resulting in a further appeal are quite slim. one is to seek what's called ombonc review to go back to the circuit court and ask for the full court to rehear the case. that's an unusual thing. the full court will only agree to rehear a case if they think a panel made a mistake in a particularly important case. the other is to seek certiori in the u supreme court which is unlikely. they take important federal issues alaw or an exceptionally important case involving federal law. here we are talking about state court -- not state court rulings, but estuary evidence rulings to the case, were things that judge kaplan allowed into evidence, the standard of abuse of discretion. the second circuit found no abuse of discretion. there's no dispute over the law that applies. it's only on how that law was applied to the fac
