timothy mcveigh's attorney joins me live from houston and then larry mackey. who prosecuted timothy mcveigh and co-conspirator terry nichols. he joins me live from indianapolis tonight. do you see any possible similarities in the mcveigh case and tsarnaev might face? >> i certainly do. i think it's very likely that federal prosecutors in boston will use the same statute, and that is one that prohibits the use of a weapon of mass destruction. that statute has application here, and as i said, i'd be surprise federal they don't bring that same charge. >> chris, mcveigh was days away from his 27th birthday when the oklahoma city bombing happened, and dzhokhar tsarnaev is 19 years old. would his youth be a factor in a potential federal case against him? >> well, youth will be a mitigating factor at sentencing, i think, should he be convicted of this, but as the guilt/incense stage of the trial, i don't know that youth is going to have a lot to do with it. i don't think that a jury is going to care too much about how old he is. he's 19 years old, an adult. it would

it's interesting that you did the timothy mcveigh case. he plu up the federal building in oklahoma city, the actual trial took place in denver. that's where they thought it would be more appropriate and he was eventually executed in indiana. do you see a similar process potentially unfolding here whereby the trial wouldn't necessarily take place in boston but maybe even moved out of the state? >> i think that whoever ends up representing him, that has to be one of their very first motions is a motion to transfer venue. because in a situation like this, we've had constant media coverage ever since this happened and none of it has been favorable for this defendant. and so the mood in massachusetts is not good for him and so getting a fair trial is going to be very difficult to get a jury who hadn't already made up their mind. and in the interest of justice i would think we would want to move the trial to a place where the citizens who make up the jury pool have not already been galvanized in their position. i would think that the government

those sound similar to the charges timothy mcveigh was charged for.rges, use of mass destruction, conspiracy to use mass destruction, destruction with the use of explosives and eight first-degree murder charges for those federal officers. i am assuming you are not surprised by what eric holder has decided to do. >> no. i'm actually reading the affidavit right now. i have it here in front of me. and it's a very specific affidavit by the fbi lead agent that specifies all the evidence against this defendant that he placed the knapsack down, that it blew up. and in terms of the elements of the crime, the specific factual elements of the crime, they seem to have an overwhelmingly compelling case. where i think the problem may come up is in how you infer intent to violate the terms of the statute from this. and i think they probably won't have a difficult time based on what i've just read in the affidavit they seem to have a pretty, pretty ironclad case. so my prediction is this case is not going to go down like an ordinary criminal trial where the defendan
