on timothy russell. but they were. and that fact precludes finding beyond a reasonable doubt that russell would have lived but for brelo's single lethal shot. similarly with melissa williams i find that russ one or two other officers inflicted two other fatal wounds as i mentioned, 13 to the abdomen and 1 to the head. so with these killing wounds from one or two people other than the defendant, i cannot find beyond a reasonable doubt that but for brelo's fatal shot or shots to williams' chest, she would have lived. as with count one, i therefore find on count two that the voluntary manslaughter of melissa williams that the element of causation has not been proved beyond a reasonable doubt. having said that the question of whether brelo's affirmative defense has been proved by a preponderance of the evidence is not moot. having found beyond a reasonable doubt that brelo did cause a wound that would have killed both of these people and having concluded that both of them lived for some moments, however brief, after those

stopped, brelo jumped onto the hood and fired 15 rounds into the windshield. 43-year-old driver timothy russell and 30-year-old passenger malissa williams were killed. this morning, judge john o'donnell spent nearly an hour explaining that officer brelo's bullets could not be proved to be the fatal shots beyond a doubt, and that the decision to fire his weapon was constitutionally reasonable. >> i find that by a preponderance of the evidence that brelo's decision to use deadly force against russell and williams was based on probable cause to believe that they threatened imminent, serious bodily harm to him and the other officers, not to mention the public. >> sreenivasan: one of the victims' family members had this response: >> but how can you get on top of this car and not be charged. and not be charged. you know what you did. >> i will never trust the cleveland police, the deputy sheriff, any police period, ever again. i will never call them to my house for anything. >> sreenivasan: brelo's defense attorney held the victims responsible for the events and had strong words for the prosecution.

there was a car driven by timothy russell and melissa williams. timothy being the driver.as a long criminal history. he drove past the police department. they thought they heard perhaps a car backfiring. the police said they thought it was a gunshot. 23-mile-long 100-mile-per-hour high speed chase. mr. russell has a long criminal history. they still don't know why he ran that night. but the point it was stopped, there were a number of officers. 13 officers who fired a total of 130 shots that ultimately killed those two people. does the backstory in terms of what happened in the mome wants leading up to the shooting go into the judge's decision? >> absolutely did. here it's interesting because you have a written decision by the judge so you can look at what is considered and how he signed it. he considered there had been this lengthy, high-speed chase, and that played a significant role in why officer brelo could have had probable cause, to have had a reasonable fear he was in threat that the other officers were in fear and in danger of real bodily harm. and that is a justi

timothy russell and malissa williams, again, unarmed were each shot more than 20 times.fficers who fired shots that night did so from the top of a squad car. officer michael brelo got up on top of a squad car, stood on top of a car, and then shot 15 rounds down at the suspects through their windshield. he was up on a police car firing down at them. he'd already emptied a previous clip. he'd reloaded in order to do that. officer brelo was the only officer charged with a crime following that completely, completely bizarre incident. the officer was charged with voluntary manslaughter. and this past weekend officer brelo, the one who climbed up on top of the car to shoot down into the windshield, he was found not guilty. 137 shots fired into the car. two unarmed people shot 20 times. that officer acquitted of everything. the verdict was announced on saturday. the resulting demonstrations in cleveland were mostly peaceful. although there were some skirmishes. ultimately 71 people were arrested for things like blocking. and this has all been happening over these last few days.
