he has always accused tish james of existing to bring him down, and tish james has never shied away fromthe issue. she said her job as elected attorney general is to pursue justice for new yorkers. this is a big deal for tish james. she staked a lot on this. >> absolutely. this was a real feather in her path, but i will say, you know, first of all while she brought the case and the evidence to this judge, the judge is the one who made the ruling. donald trump knowing him will probably attack the judge as well, but what we have here now is we have prosecutors at the state level, federal level, special prosecutors, criminal, civil. we have juries in the e. jean carroll case. we have judges in various cases especially in this one. he has tried to delegitimize all these institutions and all these prosecutors, and he started it back in 2015, right, when he was running. the fbi, the doj, and he does this -- he started this and he has been successful at it because these were all institutions and people that could hold him accountable in some way. if the facts were there and the evidence was the

because of course, it was led by tish james, who was criticized by the trump family, specifically, for having campaigned on trying to bring them down. how do you see it? >> i almost feel bad for the new york attorney general. because she did want to make a name for herself for being the aggressive trump prosecutor, only to be out shauna by a local fulton county d.a.. this was going to be her moment, and maybe not. politically, it's tough to say. because we are dealing with trump. so you really never know. also, summary judgment emotions are appealable. i expect that to be appealed. i think, in trump world, the thing that people are going to take away is that this judge was so trump unfriendly, if it was really hard for him to mask. the opinion he finds the lawyers for bringing legal arguments, saying i've already considered these legal arguments. yay, you did, at a motion to dismiss stage. they are different under a different standard of review. just the anger and animosity i think really shines through this opinion. i think that is going to speak a lot to trump world, and the get trum

in this case, you have the state of new york represented by the very tough attorney general tish james. the state of new york is the plaintiff. donald trump, and a variety of his family members and the businesses are the defendant. the allegation very similar to the allegations that we've seen from special counsel jack smith, or from d.a. fani willis in georgia. not election fraud, alleged. here the allegation was business fraud that trump over and over again, he said his apartment was three times as large as it was to get loans and insurance. his residents seven springs, his mar-a-lago estate allegedly exaggerated. >> all overinflating assets? >> that is the allegation. and both the attorney general and donald trump tried for summary judgment before the judge in new york, and the judge granted summary judgment to the attorney general and said there is no question donald trump inflated these properties. there is nothing -- what it means, there is nothing for us to argue about at trial. this is settled. also, denied donald trump's effort to get summary judgment. so we're going to have a

i want you to talk, sam, about tish james here. she says that she is looking forward to presenting the rest her case at trial. what is at stake for her? >> a lot, obviously. reputationally she has put her career, almost, on this case. she's obviously being targeted with an aggression and -- ruling by the judge was -- mentally -- appeal, but a notch one for her. going forward, she has dabbled with higher office ambitions, possibly could catapult her to those types of conversations. in the interim, this is the stuff that will be hovering around the 2024 campaign and it gets at the fundamentals, elemental part of trump's biography. remember, when he ran in 2016, it was decades of being a premier businessman with a show to boot about making money. what she is essentially doing in the case is dismantling that image, piece by piece. now, trump has changed the image, and now his business is not real estate really, is politics. and he is turning this around on her, but one part of his biography is really being put under the microscope by h

because if you actually go into the examples that tish james is putting forward, they're incredibly strongd they're objective not subjective. he's got appraisals, and then he has his own values which are hundreds of millions of dollars inflated. like this is not wiggle room area. this is blatant fraud. >> is there a chance donald trump takes the stand? i mean he's a name on both the prosecution and the defense list. >> i think there is if only because today i compared the defense witness list with the prosecution's witness list. and they are entirely overlapping except for there are probably like three or four names on the new york attorney general's witness list that aren't on that list. trump appears on both. that indicates to me the attorney general intends to call him, and he has at least said in his public statements if they call me, i will testify, i will not take the fifth. proof is in the pudding. we'll see how that goes next week after opening statements from both sides, but i think there is a possibility that the attorney general fully intends to call donald trump and all three o
