tom griffith is in the newsroom to explain what went wrong. tom: federal investigators are on the scene. that train was headed from d.c. when it derailed with 98 passengers on board. at least seven people were hurt, one seriously. investigators say rocks from a ledge fell onto the tracks, causing the train to derail. one locomotive, the one passenger car, went over an embankment. three other cars left the track but remained upright. vermont's governor calling this crash a freak of nature. >> there's no belief that there's any wrong doing here. a freight train went through late last night, it passed without any incident. so the ledges had to have fall then the last several hours. tom: the most seriously injured has been air lifted to dartmouth hitchcock in new hampshire. six others went to local hospitals in vermont. live from the newsroom, we'll have the latest for you later on, tom griffith, wmur news 9. jennifer: police in manchester have arrested a driver accused of crashing into the former dunkin' donuts on main street in manchester and the

tom: i am tom griffith. mike cronin joins us live with a preview of what happens next. mike: the money is back in the budget, and that fire station will reopen in less than 48 hours, as people and counselors look forward. -- coucilors look forward. unlike some of the contentious meetings that have taken place inside the municipal center in recent months, tonight, there was applause at the town council meeting after a battle over -- over a controversial budget. cuts of been reversed, and counselors are moving on. >>>> people have asked me, what now? the council voted unanimously to put 1.6 million mike: dollars back into the 2016 budget. council passed a budget that included cutting funding to public safety departments and the closing of a fire station. residents filed petitions, and a take place. a week ago, people overturned every cut the council made and what was the biggest turnout in the election. me. it said that the vocal minority was in fact the vocal majority. prevail. there' s no question about that. mike: fire chief michael gagnon is happy with the outcome. he

tom: and i'm tom griffith. even though thomas carroll was scheduled to be arraigned today he'll spend at least one more night in jail. wmur's ray brewer explains why. reporter: the baby's mother who was allegedly assaulted by carroll was here in court but didn't want to say anything. one of the things carroll is accused of doing is attempting to terrorize her by telling her he was going to take their 1-month-old baby girl and throw her in the trash. appearing by video in court, thomas carroll listened, occasionally shaking his head as then spoke. (inaudible) a request the judge agreed to. however, court documents give a glimpse into what police believe happened. friday morning police were called to 72 bow street in franklin. according to the affidavit, carroll had locked himself in the home with his 1-month-old daughter and was threatening to hurt her. >> once we learned that there was a hostage and especially a baby being a hostage, i certainly wanted to ensure the safety of the child and anybody else in the r

welcome back, everyone, i'm tom griffith. jean: and i'm jean mackin. since spring the town has had six water main breaks. tom: that's right, and wmur's suzanne roantree talked to town officials about the ongoing problem, and this latest break, and she joins us live in the studio. suzanne? reporter: it was just after midnight when utility workers were called about the water main break at the intersection of main and pleasant streets. it's just one of many to plague salem over the last five months. since the middle of may, salem utility crews have been called to a half dozen water main breaks. not unlike other new hampshire communities, the town's under ground infrastructure is aging. >> the age of the pipes in this area are pretty odd, from the 1890's. this one here is early 60's, it's an older style pipe, cast iron pipe. reporter: while the water main breaks are a nuisance for drivers, they are also costly, not just at the town itself, but also to businesses like the tuscan market. joe says he got an early morning phone call alerting tom the situation.

tom: and i'm tom griffith. our other top story tonight, a jury is deliberating the fate of 19-year-old tristan wolusky from rochester who faces first and second degree murder charges. he's accused in connection with a stabbing death of 18-year-old aaron wilkinson in madbury in june of 2014. wilkinson's body was dumped in maine. jean: jennifer crompton joins us live from dover. reporter: well, there are a lot of givens in this case, we know that tristan wolusky went with two friends to madbury in june of 2014 with the intention of robbing aaron wilkinson of we know the 18-year-old wilkinson was then stabbed over 20 times and his body dumped, along a road in maine. and we know the other two friends cut a deal with the state, they pled guilty to second degree murder, in tonight a jury has to figure out what role he played in a case riddled with accusations of lying. >> tatum and pinette made the decision to take knives up the driveway. pinette made the decision to hack aaron. that was never discussed. reporter: ac

good evening, i'm tom griffith. jennifer: i'm jennifer vaughn. before learning his sentence, owen labrie heard not only from the victim herself but her poorns too who focused on what they called his cruel intentions. wmur's andy hershberger begins our live team coverage to you from outside the courthouse in concord. reporter: labrie was sentenced to one year in jail and will serve up to three years probation, but the 20-year-old will still remain free while his case is under appeal. the teen-age victim in this case gave her statement to the court through videotape, it talked about how her life was forever changed when she was sexually assaulted by owen labrie. >> made me feel like i didn't belong on this planet. and that i would be better off dead. reporter: labrie was convicted of five charges related to the sexual assault of a 15-year-old, while both were students at the in may of 2014. the assault took place during a school tradition called the senior salute where upper class men ask younger students on dates. labrie's lawyer asked the court t

i am tom griffith. police searched her property twice before and found nothing, but after being summoned to the apartment a third time, they found her body in a crawlspace. adam sexton' s live in manchester with our top story. adam: friends and family members had been holding out hope, hopeful sue hutchison could be found alive. the search for sue hutchison who was missing for the last three weeks appears to have ended with a gruesome discovery at her apartment. she disappeared from her home september 20. >> last night, we responded to a call for an odor coming from her apartment. family members called it in. we did an extensive search of the apartment, which we had done twice previously. this time, we were able to locate a hidden crawlspace that adam: investigators found a body. >> something had been discovered, and i was anxiously awaiting to hear the news and hoping they had found something good regarding this situation. >> sue has been missing since september 20. she lived in manchester with her roo

good evening, new hampshire i' m , tom griffith. adam sexton joins us live from hudson tonight to explain what police say stands out about this criminal duo. adam: police tell us that the male suspect has probably done something like this before. to the point he is getting overconfident. they say when he walked into the walmart this afternoon, he took off his hat and looked up at the security camera as if to say ' catch me if you can' . hudson police say these two suspects targeted an 89-year-old woman at wal-mart monday afternoon. one got the woman' s attention while the other rifled through her purse. >> she was distracted by a male subject to help pick out some merchandise. while she was distracted a female counterpart reached into her shopping cart and grabbed her wallet out of her purse and made off with an undisclosed amount of money, and also some cards and some sentimental items as well. the store' s surveillance cameras adamthe store' s surveillance cameras: recorded these images. the man is described as possibly hispanic,

they are safe tonight after the m shelley walcott. m tom griffith. police in derry say they found severely malnourished animals just in time. jean mackin explains why the facing charges. jean: police in dairy say neighbors called in, reporting the possible neglect of pets at a home in town. and they arrived, they say they living in filth. when police arrived on friday, they found this force in the yard. a veterinarian call to the site said the horse was severely underweight and malnourished. it was immediately removed from the house on mckinley avenue in derry where police say a woman was keeping three dozen pets in poor conditions, including 17 with six cats, three dogs, a guinea pig, and an iguana. >> we determined that she had fallen on hard times. she was unable to care for the animals. luckily, she voluntarily gave them up. jean: police say animal waste cover the floors of the home and cages. the stalls were filled with manure, and many of the animals had no access to food at all. the spca in stratham are going to work to bring the animals back
