tom jenson is live in san jose with the details. good evening, thom. >> this is what is supposed to happen to a million dollars worth of toys donated by the dynacraft wheels corporation. more than 8,000 electric cars and scooters worth hundreds of dollars each going to poor families for christmas. >> it's nice, it's what they're doing for us for people that can't afford one of these. >> the county learned this week that some of his staff and other county employees were given dozens of the toys even though they were supposed to go to the needy. they say they don't know how many toys went to county workers. >> there's no way to determine that other than it's been estimated between two and three dozen. the employees were told they need to return the gifts so they go to the right people. but the county executive down played the give away and immediately told workers they're not legally obligated to return the toys. in a strongly worded statement, they said the toys did go to less fortunate families. he also took some jabs at the assesso

. >>> "today in the bay's" tom jenson is live at the crossroads shopping center in pleasant hill to show us the new video of the damage left behind. tom. >> there was, as you said, one person hit, only one of the suspects in the shooting, the victim who may have been in an argument with the shooter in the parking lot about 9:15 last night when this happened. there were a lot of shoppers here, very fortunate that none of the shoppers were hit. witnesses told our photographer there was an argument in the parking lot and all of a sudden there were numerous gunshots, they said. the witness said many of the bullets hit buildings, and i think you can see that our video here with shoppers inside, including this starbucks. starbucks employees said they saw a man bleeding, running towards the business and then take off in a speeding cars. the high-speed reckless toyota was later reported north on highway 232 just after the shots were fired. we were also told windows were broken and there were holes in a lot of exterior walls. pleasant hill police spokesman said it's lucky no shoppers were hit. >>

live on the stanford campus, tom jenson, nbc bay area news. >>> in the south bay, a dubious distinction for san jose. the city now investigating its 46th homicide of the year. that's the highest homicide rate in a decade. the latest incident was last night. a gunman shot and killed an 18-year-old near the san jose campbell border. police say it is gang-related. and they add, it's not easy to explain why the homicide rate is up, but they say increased staffing within sjpd can only help. >> this time that it occurred last night. even if we had ample staffing, it would have been very difficult to prevent this homicide from occurring, because we can't be everywhere at once. >> again, they believe it is gang-related. the department also stresses even 46 homicides is relatively small, compared to the homicide rate in similar large cities across the country. damian trujillo will have more on the story and san jose's safety debate. >>> overseas. investigators in berlin trying to figure out why a truck driver plowed into a crowd this morning, killing 12 people and injuring 50 others. it happened

let's get straight to "today in the bay's" tom jenson who is at the scene. what's going on right now? >> reporter: this is a bad accident. this car was hit head on by a wrong way driver. these were all women driving here, all female victims. no fatalities. i just learned from chp that the driver of this vehicle, a young woman possibly in her 20s in this heavy aveo, her car was upside down. she was trapped in it. she was screaming for help. firefighters got her out. she's been transported to the hospital with major injuries. let me show you what happened to this car. it was hit by a volkswagen parked way down there right now. the motor came all the way out of this car. you can see it on the highway on 280 southbound. just down the road is a white bmw that crashed into the back of one of the cars, a volkswagen after the accident happened. what we understand is what possibly happened is that the volkswagen came off of byrd avenue the wrong way going right through the do not enter sign, going north on 280 southbound and ran into this head on into this red chevy
