roger stone. let me start with the gag order. the judge in this case saying you can talk about tom brady and other things, but would restrict what r stone would be able to say. what does that mean for the case? how likely is it to happen? how rare is it? >> it's rare, but the local rules in the district of columbia allow for a gag order preventing extra statements by attorneys, parties and anyone else associated with the case, including courthouse personnel. some of this stuff always leaks one way or the other. this may be a case, even if the judge issues a gag order, it says you can't take discovery that you get and hand it over to other parties. the court can enforce that through the rules. so, this may be one of those cases where the potential for extrajudicial publicity is so great, the judge may have to issue that order. the supreme court said, if there's too much pretrial publicity, the court has the obligation to safeguard his rights that way. >> you saw what we learned from this filter review taking place of all that. help us understand the quantity and what they are looking at. >> prosecutors described it in terabytes of

roger stone case. there you go. the president judicial watch also working with the international policy form. tom, good to see you.'s start with the good judge. she has had quite an impact already. what do you expect to have happened in the manafort case? >> i'm sure he will get a higher sentence than he anticipated. courts too often have been to differential to the special counsel. their expansive reading of the laws on the suggestions that he lied to them. i just don't think he's in a position to say hey, is trying to be honest with you. i may have misremembered a few things. these judges keep coming down on the side of the special counsel operation. the justice department is just letting the smaller special counsel really stomp all over these various defendants. for what public interest, i'm not aware of. >> lou: let's turn to the witchhunt itself. that is, of course extensively it is about to ramp up, we hear from various reliable or not so reliable quarters. what do you think? what does judicial watch thing? is this thing finally coming to an end? >> i hope so. but i don't think so. it was just reported today

tom winter. he's reporting on something else i want to get your legal perspective on. rogertone and that instagram post that stone put up showing the judge, the judge who is overseeing his case, with a picture of a cross hairs next to her. that was removed. right? he issued an apology. he reposted a different post on instagram. now there is a hearing for this afternoon scheduled by the judge about why the order entered in this case, she says, and his conditions of release should not be modified or revoked in light of the posts on his instagram account. roger stone, if i'm understanding this, made a mess of this on instagram. now this could have serious legal implications for him in court. do i understand that right? >> i think you do. stone was trying to be cute. i think he was trying to force the judge into a situation where she would do something that he could use to argue that she needed to be recused and needed to step down from the case, but the government only has to establish one of two things to revoke a defendant's release pretrial. either that they're a flight risk

tom brady as much as he wanted. we love a little judge humor. judge jackson warned roger that treating the build-up to the trial, quote, like a book tour could taint the jury pool. and then offered this ominous warning for the famously loose-lipped self-described dirty trickster. quote, the defendant should be aware that to the extent any of his public pronouncements turn out to be inconsistent with each other or bear on the facts of the case in any way, the office of special counsel will be free to introduce any of them as evidence against him at trial. maybe roger stone wants that gag order after all. remember, this is the same judge, amy burman jackson, who presided over roger stone's old pal and one-time business partner paul manafort, second trial. she sent manafort to jail because manafort was contacting potential witnesses. and today the judge warned stone not to try to pull any of what manafort did. quote, it is a condition of your release that you may not contact any of those individuals or any individuals that you believe are witnesses in the case in person, by

roger stone had been doing. he said it was okay to talk about immigration or tom brady but not about the facts of this case. she said she's entertaining a gag order and she asks both sides to submit briefs. i guess the main news that came out of this today, nicolle, was that the mueller team talked about a trial date of october in the fall. she said she would prefer one in august but she would entertain october. some are not objecting to that, going along with waiving the right to a speedy trial because of the massive amounts of evidence rob the mueller is essentially dumping on them. he said he sees terabytes of information, i believe, over the course of a year or more in subpoenas to telecom providers and to -- you know, banks and financial institutions. now he's turning that over to stone's team with hard drives, and they have to go through it all. he also sees some material in the search of stone's house and office. that they are still going through. they're doing a filter on that to make sure none of it is privileged. they also turned that over to stone's lawyers as well. it will take some time before
