tom. what do you think? >> i think this is going to be the kickoff point. this is not the last trump-related case the supreme court is going to wrestle with. look, i agree. i think any time this supreme court dips its toes in the political waters, there's concerns from the institutional perspective. chief justice roberts is worried about that. there's going to be some sheegmt of the person population that sees this as a charged decision. i agree with john. i could see the chief assigning this opinion to himself to write because he's going to want to do whatever he can to muster as much unanimity on if bench as he possibly can. in a case like this just with as other historically cases going back to brown versus the board of education, the supreme court tries to speak with one voice to show there's no divisions on the bench. >> neil: if i can go back to the president biden case, john. i was rifling through it. i didn't know half of what i read. i find it interesting that you have a special prosecutor painting him as a sympathetic person before a jury. would would you bring that up? >>

trump. this was a political hack job and they knew he was running for president. liz: tom, we read through the court filings and read through this case. doesn't this point out the dangers of this obscure new york state law, it is very loose and associated press looked at nearly 70 years of cases here, found nothing like the size of this one. tom, couldn't an appellate court overturn or modify this fine as disproportionate? what's the restitution for? the state didn't identify any victim losses. the new york law doesn't require a showing of any victims or harm or damages so that anyone was defrauded. what do you think? >> it can be a dangerous combination and this case illustrates what can happen and people engaged in what they consider ordinary business dealings and ultimately results in a judgment that probably will be north of $400 million with interest plus prohibition on conducting business. look, your question, i do think that trump defense team will have strong arguments on appeal. i think it's an uphill battle, no question, but i think they can argue that the judge
