supreme court rulings, our chufr legal analyst jeffrey toobin is with us. the president tonight suggested he wants to delay the release, even the start of the 2020 census, is the administration going to keep fighting to add this question? >> absolutely. the census will go forward in 2020. it has to under the constitution. it's one of the few very specific commands in the constitution, that there be a national census every ten years. the question remains -- will the question about citizenship be in there? the supreme court today, chief justice roberts said the justification that the administration offered was bog gus, it was not believable, but he said go back to the district court, judge jessie furmen, and see if you can come up with a more credible question. that process will go forward and presumably appeals will go forward before the issues is resolved once and for all. >> so the high court is leaving the door open here, right? >> right. i think it's important to emphasize that, that this was a defeat for the administration on the citizenship question, b

jeffrey toobin says maybe it's time for some of the house investigations to investigate it.at he means bring people before the committees that can add insight to what is inside the mueller report. john dean isn't in the mueller report. these two former fbi officials who you'll hear from on wednesday not in the mueller report either. your committee is talking about the counterintelligence implications. what does that mean? >> a lot of what was redacted in the mueller report, john, had to do with intelligence matters. it's redacted because it makes references to sources, to methods for gathering information, and that is part of this story that has not yet fully been told. what do we know about what the russians exactly did to prepare the many, many approaches to the trump campaign. who is involved? what methods did they use? did they use companies other than twitter and facebook? a lot of that information is not yet public. a lot of the redactions in the mueller report of course pertain to that. it's really important that at a minimum congress knows the full extent of the russ

jeffrey toobin, should democrats negotiate with the justice department on these terms?e justice department had shown any willingness previously, any stofrt good faitd, th faith, they probably should have. but since the response to congress across the board has been basically, go to hell, you're not getting anything, it seems much smarter for congress to vote the contempt and then maybe negotiate. because otherwise, they would kick the can down the road and wind up in court anyway. this way, at least, they can go to court and try to get this resolved sooner rather than later. >> why do you think kaitlan, the justice department is now willing to discuss this to avoid a full vote on the house floor that could lead to a contempt citation against the attorney general? >> well, their argument is that the new request is a little bit, it's narrower in scope, it doesn't have the same legal issues that it had before. that had been their argument, it was too broad and too expansive and they essentially just wanted everything without having a purpose for some of the documents and t

for more, let's turn to jeffrey toobin and washington correspondent for new york magazine who did a profile story on hope hicks just before she left the white house in the spring of 2018. i want to get your big picture take on what we saw or didn't see but at least heard about happening in that hearing room. >> you remember on election night at the midterms, like the democrats are retaking the house. they will be able to conduct all these investigations and what do we know after six months? that the stone walling has worked. none of these investigations have produced really anything of importance yet because at every step whether it's documents, witnesses, all sorts of different committees, the white house has refused to produce anything and the court fights by in large haven't even begun yet. the strategy has been as you said drag it out but put it in the court system which is not set up on a political schedule. so, you know, the odds that there is a definitive decision on any of these issues, whether it's the tax returns or the documents or hope hicks or don mcgahn before the end of 2019,

let's bring in our analysts and jeffrey toobin, let me get your reaction.u raju is learning that democratic staff and gop staff have gone over to the justice department to begin reviewing some mueller probe documents as part of the new deal reached between the judiciary committee and the department of justice. this, according to multiple sources with knowledge of the review. what's your analysis of what's going on? >> you know, i think this is a bigger deal than eefr the hearing today. you know, this is not about people's opinions. it's not about spin. this is about the evidence in the case. and, yes, it's true we have the mueller report, but it is certainly true, too, that there is material in the underlying evidence, the fbi 302s, the summaries of the interviews that will be of interest to the public. and i think getting access to facts, to interviews, to statements by witnesses is what the investigation needs. it also needs live witnesses. it needs don mcgahn to testify and other people to testify. this is an important first step in a real investigation.

. >> i want to bring in frank bruni, susan glasser, and new yorker staff writer, jeffrey toobin, cnn chief legal analyst. frank bruni, joe biden says he feels that way two days ago and for decades before that, he felt differently. why the shift? >> there are two things going on here. one is the shift is the democratic candidates for president have moved to the left, right? and he was further further toward the center and he made the determination that was not a politically profitable place to be. but we've all talked about joe biden's campaigns in the past and the wobble in them and how they haven't been so successful. i don't understand given that this was out there in the pace of less than 48 hours, they say, yes, he stands by his old position. and less than 48 hours later, they say, no, he comes out and says, no, i've changed positions. this isn't -- just so viewers are clear on this, this isn't that he had had this position for decades and it hadn't been reiterated or revisited lately. they came out on wednesday and said, this remains his position and said it almost as a point of

jeffrey toobin, what do you think of these developments?hy it's good to have prier primaries. it's a substantive issue. bill clinton was a supporter of the hyde amendment, but the democratic party is not there anymore. the hyde amendment, all medical coverage is allowed under medicaid kpeexcept abortion and that is something most democrats object to. >> this is something he had been -- that sound bite, put that aside. this is something that joe biden had been very consistent on for his decades in the senate, his support for the hyde amendment because for most of that time he had a lot of democratic companies, to jeffrey's point. because it had not been and has not been a litmus test for being for abortion rights. the idea of taxpayer dollars for abortions had been in a different category politically and policywise. and joe biden is doing something that we maybe aren't so used to, which is he's sticking to that, and he believes that because of his faith, for a lot of other reasons, he's sticking to this. it is not beneficial for him in the s

joined now by jeffrey toobin, manu raju on the hill. jeffrey, as adam schi iff made clear yesterday, this was not a friendly subpoena. mueller did not want to come to testify. he is coming to testify. so the question is what is he willing to answer? how often will he say, listen, hey, it's not repoin the reportt go there, i'll refer that to a private session? how much can the special counsel do that when he's in the chair facing these hard questions? >> he can do it a lot. there really is not an immediate mechanism that the democrats or the republicans for that matter can use to force him to answer questions once he's in that chair. i think they can rely on his good faith. i don't think robert mueller is perceived as someone who will misuse the law, but it is a difficult position for the members of congress to be in because it's not like there's a judge who will force a witness to answer the question. the only power they have is essentially the power of suasion. obviously you can threaten to hold a witness in contempt, but i think reali

jeffrey toobin, he may be denying it but the campaign actually fired a few pollsters as a result of thes of these polls. these are three month old polls. is this a case of shooting the messenger? >> it sure seems that way. you know, the only thing that matters is whether the polls are accurate and if he can't acknowledge ha he's got an electoral problem, that's his problem. not his opponent's. if i were the democrats, i'd be delighted to see him pretending his political standing is better than it is. but the job of pollsters is not to u curry favor. it's to provide accurate information. we'll see whether he gets the that. he even fired kelly conway's company as you know, as one of the companies that was polling for him. >> in 2016, he often would dismiss the polls and went on to win the electoral college. lost the popular vote by about 3 million votes. are you surprised he's so upset by these numbers this time? >> not surprised. in 2016, no one expected him the win. i don't think he expected himself to win. so it was easy to dismiss the polls knowing or thinking at the end of the day, i
