for more we're joined by tracie potts and democrats seem to have enough votes to block that this week so will that be enough? >> reporter: it may not be because they may be looking at what's called the nuclear option here, lowering the thresholds of how many votes are needed to get gorsuch on the u.s. supreme court. he cleared committee, now there are enough democrats willing to filibuster, something never seen with a supreme court nominee, that they could block this nomination without that rule change. take a look. four democrats bucking the party so to speak, three from red states up for re-election. the other from a home city of gorsuch, from denver. all of them saying that they won't block this nomination. but 42 other democrats plan to do just that, forcing, republicans say, forcing the party into this nuclear option where they can essentially confirm gorsuch without any democrats on board. they've got the numbers to do it, but is that going to pave

tracie potts joins us from capitol hill with the latest. this is the nuclear option. >> right.e've been calling it the nuclear option. here's what that means. they changed the rules so republicans can get done what they want to get done without any democratic vote. a few democrats said they will vote for gorsuch, but not enough to reach the 60-vote threshold. so starting this morning and for two hours there's expected to be a series of votes that will lower that threshold to a simple majority. so republicans can get him confirmed with 51 votes. we have not seen this happen, and now democrats are frustrated about it. saying if you have a nominee that can't get 60 votes, you need a different nominee. the danger of this, they won't be able to get gorsuch confirmed to the court, but the real danger is what happens down the road because of this split. they're not building goodwill for what will happen in a couple weeks. they have serious spending bills that have to be passed. what happens after that? tax reform, a tough issue is that the president wants to dole with and circle back

tracie potts will join us in a bit. >>> in earnings, united continental reporting a beat.he company addressed the passenger who was forcibly removed from one of its flights last week. that did not impact the financials. landon dowdy joins us with more. >> good morning. shares of united up more than 1% in early trading today following the better than expected results. the airline posting earnings of 41 cents a share compared to the 38 cents analysts were expecting on revenue of 8.$8.42 billion. despite beating first quarter expectations, united did not take any time for a victory lap. the airline operator has been at the center of apassenger, dr. dd dao, being dragged off an overbooked united plane last week. and munoz issuing another apology saying we need to do a much better job serving our customers. this incident la behas been a humbling experience and i take full responsibility. this will be a watershed moment for our company. traffic and capacity for the first quarter up 2%. united says they expect passenger revenue to be up between 1 % and 3% for the second quarter.
