the dead horses were discovered off this property near tracy around an electric tower and visible to motorist. >> i just drove by and saw the horses and -- turned around to see what had happened. i just can't imagine anybody leaving animals out here like this. >> reporter: a rancher driving by spotted the caucuses from the road and called authorities this morning. in all five horses were found dead. two still alive but very dehydrated. investigators say this trough on the property was bone driest mated to have been empty between three and four days during which the temperatures reached into the high 90s. >> they were well nourished, it wasn't that they were without food, but water, the lack of water is what killed them. >> reporter: investigators are looking into if the water was turned out of and if this is neglect. >> if it's neglect we will make sure that the case gets submitted to the district attorney and seeks the appropriate charges. >> reporter: ktvu has learned investigators spoke with the horse's owner this afternoon who told them the owner believed the horses had access to

tracy grant is live to show us the video. tracy? >> reporter: lisa, the surveillance video came from this area right behind me and it shows a good portion of webster street. in the minutes right before this shooting took place. oakland police want you to take a very good look at this video. they need help trying to figure out who these people are. >> this side of the street they're walking on is the same side of the street the victim's vehicle was parked. >> oakland police detectives say this couple is walking towards the spot where she was shot and killed on sunday night. police believe these two, a male on the left and female dressed in baggy clothing on the right, are the ones responsible for his death. the video was recorded at 11:25 p.m. and the 911 call reporting the incident came in at 11:32. detective mike gantz says you have to consider the lag time that takes place between when witnesses see a crime and when the call is transferred from chp dispatch to oakland. >> as you can imagine that's seconds and minutes wasted. that

. >>> an investigation is under way into what took place in this pasture near tracy that left several horses left -- horses dead. two others were severely dehydrated and they are now being treated. >> reporter: this is pioneer equine hospital about an hour east of tracy, it is a large modern facility where two of the surviving horses were brought for treatment. due to confidentiality, they cannot talk about the condition of the horses or their progress. a passing rancher spotted the caucuses and called the sheriff's department. four horses were dead on arrival and a fifth found in an area of sparse shade died shortly thereafter. a trough on the property was completely empty. investigators say it was likely dry for three or four days when temperatures soared into the 90s. the horses belonged to the property owner. a veterinarian on scene said the animals were well fed, it was solely the lack of water that killed them. ktvu has learned that the owner of the property told investigators that there was water available on an adjacent property and that a gate that should have been opened was

for "california country," i'm tracy sellers. >> hi. i'm chef paul murphy. and today, we're going to make an absolutely fabulous strawberry salad with bleu cheese from point reyes. i have some romaine lettuce, some strawberries, some carrots. and we're going to finish it off with a balsamic glaze. these are the simple steps you're going to take to enjoy this wonderful strawberry salad. some romaine lettuce, we're going to cut it as strips. next, we're going to slice up some of the strawberries. we're going to place these ingredients in a bowl, add some of the carrots, and last but not least, that delicious point reyes bleu cheese. we're going to put, oh, a nice amount. we'll chop it up. so we'll toss this. we'll add some of the balsamic glaze. what it is, it's pomegranate syrup, and i reduce it, and i add balsamic vinegar to it. so it's a wonderful, wonderful alternative to something else. this dish can be enjoyed as a first course, or i would serve it as a dessert with a nice port, or maybe a big cab, and you finish off a lovely evening at home. so there's

in san francisco, tracy grant, bay area news. >> thank you, tracy. >>> a bay area man sent to is an quentin for a horrific drunk driving accident has been killed by another inmate. the prison officials say 44-year-old edward schieffer was stabbed with a makeshift night in the prison's reception center yard. he died later that night, ten days after he arrived at the prison to serve 24 years to life in prison. schieffer was convicted of second-degree murder for killing a 9 year old girl and seriously injuring her father as they walked in a crosswalk. he had nine pryer dui's. they say the 31-year-old is suspected of killing schieffer because he was convicted of first-degree murder for killing a 59 homeless man in san jose in august of 2007. he arrived at san quentin in january to begin serving a life sentence. >>> oakland is now set to become the first city in the country to allow medical marijuana factory farms. late this morning, oakland city council approved the plan including setting environmental and safety standards. the council approved a total of four permits to megamarijuana farm. the
