transocean owns the deepwater horizon rig which exploded and caused one of the biggest environmental disasters in u.s. history. the settlement includes $1 billion in civil penalties and $400 million in criminal penalties. america's federal trade commission has decided not to take legal action against google over their business practices. a 20 month investigation found they had not biased its search results to favor its own products. the company has agreed to make a number of changes and promised to give advertisers access to more reformation. from all this, let's speak now to a former editor of wired.com, joining me from san francisco. good to have you here. victory for google. are you celebrating? >> i think it was a good process. google having to be under the regulatory gun and have people look closely at what it is doing is a good thing for everybody. they are a huge, powerful force on the internet. my sister when she talks about the internet or the web, she talks about google, i need to go to google. to have the regulators tell them i have to watch where they're going is a good t

at this point the justice department now done with transocean after transocean agreeing to admit to guilt to pay that $1.4 billion settlement. that was criminal costs and some of that money will be going to the gulf states to help pay for repairs and for continued management of some of those biological areas hit hard by the dafter. >> where does it stand? bp has civil claims pending and the question is whether transocean now has gotten a case closed. >> well, case closed with the u.s. government, yes. all parties involved in this are pointing the finger at another. they had to pay 4.5 billion to the u.s. government and that was a settlement they reached in november on the criminal aspect. they are looking at working out a figure and what they are going to pay in terms of clean water act penalties. that could be billions more and they always argue and putting out a statement pointing out the fact that there were multiple parties and causes that led to the disaster and they are pointing out that transocean is admitting to its part in the disaster and waiting for halliburton to do the same.

let's talk about transocean. here it is.out 6.6% right now coming out, they have agreed to pay $1.4 billion settling charges the u.s. government, back in 2010, the findings were tough for them, and now they're settling this. some thought it was a good price, some thought it was more than they anticipated. it takes away the uncertainty, the really big spill back led to so much scrutiny in the oil market, drilling obviously was quite detrimental. transocean shares have been on the rise because now the uncertainty takes away the questions that surround that. liz: to know you have the boards near you. a market at or near the lows of the session. the federal reserve minutes are in. the tapping of the breaks. nicole: they might hit the brakes we might not have collated going forward. the committee on whether or not we really need all of this stimulus. liz: thank you, nicole, and thank you to sandra. sales for the big retailers upped in december, but it is a different story for the discounters. shares of family dollar falling off a

transocean shares are jumping. >> this is a big deal. a big deal on the fact of money they set aside what they will have to pay out is actually less than what they set aside. this is news for them, great news for them to have clarity. to have the whole thing done. let's start off and let's look at transocean. rig is the tickle symbol the up 6.7%. you remember of course the terrible explosion in 2010. there were lives lost. but they are trying to move forward and settled the claims along with the justice department over the deepwater horizon accident. there's a look at the stock. it is up $3.11. they will pay $1.4 billion in total total claims to settle this and this is obviously as i noted less than they had set aside. so halliburton has to settle up. its shares have been to the upside. this is breaking down, the 1.4, a billion in civil penalty, 400 million for criminal penalties. all this dates back to 2010 when we covered it so closely here on the fox business network. here today doing quite well. this is nice one-year chart. still not

so continue to watch halliburton, but transocean shares are doing very well, three days in a row. it the new normal? the labor department reporting this morning only 155,000 new jobs added last month and the real unemployment rate, no change, 14.4%, that includes people who are underemployed or stopped looking for work. monica, tell me. >> the unemployment rate is 7.8% which is exactly where it was when president obama was sworn into office. their slogan forward really has extra resonance now. as you mentioned, the actual unemployment rate is 14.4%. this is disastrous. 155,000 jobs, if that the number is to be believed and if it stays without revision, last year and the year before, 2011 and 2012, the average monthly jobs gain was 153,000. this is not a dynamic economy, not a growing economy. stuart: and yet we have the white house releasing verbatim exactly the same statement today as they released at the november report. they changed the date, that's it. first paragraph, verbatim, same. >> you are calling it the new normal, this cannot be our new normal. we can't settle for this
