trevor: good to be with you all today.n the past couple days, vice president biden has been declared president-elect by the ap and a number of tv and cable networks. this reflects his apparent wins and states having more than 270 electoral votes. up,he current total holds he will have earned around 306 electoral college votes, which president trump termed a landslide when he got that number four years ago. he will have slipped arizona, michigan, wisconsin, pennsylvania and georgia. we all understand these are unofficial results published by state election officials and they still need to go ahead and canvassed them, which means check them and produce final numbers. state where the totals are sufficiently close, georgia, that there will be an official recount, a hand recount, and there are two other states, nevada and wisconsin, where the losing candidate may ask for a recount and trump has said he will do so. the important thing to understand about these recounts is that they are unlikely to change any state election resul

trevor what is mike pence's role in this? is silence and standing by as trump kind of lights this thing on fire okay? >> well, you know, not in his vice presidency has pence ever disagreed with the president. i'm more concerned about republican leaders around the country and in the senate. you mentioned mitt romney, but the mcconnell position has been that we'll let the lawsuits play out. well, they are playing out and the recounts are playing out and they're not changing anything, and there is no prospect given the size of the biden win in the electoral college and in the various states that they could play out. you look at michigan, where there was a fight over certifying wayne county. the question was, were they a couple hundred votes off or not in the election books? in a state which biden won by 145,000 votes. so i think the question is, where are the republican leaders saying this is dangerous, you're playing with fire, to suggest that in michigan leaders should come to the white house and somehow find a way around the

trevor, i want to jump in first with you. as we're still waiting with regard to michigan, what in the law allows this republican to vote not to certify? like how is he allowed to make that decision personally? >> he's really not given that discretion. this is an automatic act. the law says that they shall certify once the votes have come from all of the counties in michigan. and every county has certified their results to the state board. so this is a ministerial function. what they're saying is we got the results from the counties, here are the results. and that's not discretionary. it's worse than that because the reason that the one republican has given for the possibility of voting against certification, appears to have tipped his hand and said he will, is that there are 300 votes in question meaning they're not certain

trevor potter is with me.e just listening to my conversation with mitch mcconnell, listening to my conversation with mark. what do you think of this? >> i think mcconnell is trying to put the best face on this, and he's, of course, correct that when you have close elections, under state law, there are circumstances in which you can have recounts, and there are going to be some recounts. it looks as if there will be in wisconsin and georgia and probably nevada. so he's correct in saying that all the votes haven't finally been counted and recounted yet, but we're almost in the place. arizona is the one everyone is looking at where, when arizona with a biden lead that looks substantial enough that he will get those states, once that has happened, even with the recounts, there is not sufficient room for trump to win this. that, i think, is the key fact. even though mcconnell wants to wait for recounts, joe biden will have a majority in theie electoral college of states where he has won the popular vote in those st
