trey gowdy is live outside the new york state supreme court. trump's lawyers alina habba over the weekend who suggested that these jury instructions will likely or unlikely be appropriate for this case. where are your expectations? >> i was in the courtroom for two days last week and i have seen pro-prosecution judge before. i've even benefited from a few of them. i've never seen a judge of more pro-prosecution then a one i watched last week. here's the challenge for the defense. the jury identifies with the judge. it's almost like stockholm syndrome. that's who's been taking care of us for weeks and weeks so it doesn't do a whole lot of good to attack the judge heard what you have to do is attack the prosecution and the prosecution case. speaking of jury instructions, how in the world. this is what i would argue. how in the world can you find somebody committed a fraud in furtherance of a crime when you don't know what that other crime is? you don't know the elements of it, you don't know the name of that, you don't know the evidentiary burden
