nbc bay area's damian trujillo spoke with the teacher today and joins us from san jose. what's the story here? >> reporter: the teacher says his friend was being detained at the time. he asked the officers why they were frisking him, the teacher tells me the next thing he knows, he found himself on the ground. this is cell phone footage that nathaniel howard shows san jose police were roughing him up for asking why they were frisking his friend. >> you know, shoved, thrown to the ground and beaten. >> reporter: howard spoke to us via skype. he'd just given a commencement speech at san jose state on may 24th. howard says when an officer told him he was ignorant, things got out of control. >> it's been tragic, i've had a lot of trauma, and, you know, i've cried. i've cried my tears. >> reporter: san jose police say they do not comment on any internal affairs investigations. worried nothing would come out of that investigation, howard approached the lawyers committee for civil rights in san francisco, which filed a formal complaint against the department. the complaint seek

nbc bay area's david trujillo during some of the confrontations there. damian joins us live at gaud lup pe church. >> reporter: the services here begin at 5:30 this afternoon. these are some of the collection bins that the parishioners have been filling over the past couple of days. crews just picked them up. those donations are now on their way to san diego. they spent the day packing boxes with toiletries and other supplies. ready to ship to southern california. >> specifically needing donations for women, for the moms coming with their families. >> reporter: thousands of immigrant children have traveled 3,000 miles since october, to make it to the u.s. and this is the reception they've gotten in many cities across the southwest. in california, protesters managed to force three bus loads full of immigrant children to turn around. >> it's really heartbreaking. >> reporter: today santa clara county said bring them here. the south bay is actively looking for a building to help process the immigrants, and looking for temporary foster homes for those childr

nbc bay area's damian trujillo joins us where the registrar just finished the count. what do we know? >> reporter: finished counting the signatures early this afternoon, raj, and in the end the cannabis clubs lost. the signatures were part of a petition drive to put two measures on the november ballot to stave off new city rules. those rules include new zoning laws limiting their locations and requirements about where pot can be grown and how the club's security is set up. club owners say the rules ensure nearly all of the cities estimated 100 medical marijuana clubs will have to close. the clubs needed thousands of signatures in 15 days to get the initiatives on the ballot and had even offered free samples to try to get voters to sign on. they got less than the necessary signatures they needed. >> we will retain the petitions, but will not be forwarding them for verification, and, therefore, the ordinance stands. >> everybody was, you know, there's a bunch of people put out of work, it will be much harder for patients to get medication, and the city will get less tax

nbc bay area's damian trujillo first broke the story on friday and joins us now from san jose city hall. what's the mayor's response tonight? >> reporter: he's talking, raj. this is the settlement document that the unions were working on with the city manager, but today, the mayor said this is unacceptable and instead came up with a new ballot measure, one the unions call a deal breaker. the police and fire unions say they're surprised how quickly they were able to work with city manager. they hammered out this deal, a settlement agreement to end the measure b litigation, but the mayor and city council didn't buy it. >> you had an agreement. >> yes. yes. there was still some fine tuning to work out on some of the issues. >> reporter: so at this point, you don't like what you've seen from those settlement discussions. >> at this point we don't have a proposal that's acceptable. >> reporter: so the council pitched another ballot measure instead, one that would change parts of measure b. the council proposal angered the unions who thought they'd made progress with the city manager. >> this
