when they talk to tsa, tsa says it's the sporesponsibility of t faa. so they find this finger-pointing back and forth frustrating, as i do. i'm a member of this committee and also a member of the homeland security committee. we will try to work through this and find out how to coordinate better to make the necessary improvements we need to make. right now i'm working on legislation that will allow the airports for passenger facility charge and i would like to hear from you, if confirmed, would you ensure the tsa does its part to help the airports with security infrastructure projects? >> yes, sir. if confirmed, i think one of the first things to do is make sure that people are brought to the table and talk with each other. bring security director to the faa lead in that airport and airport authority together to have a conversation as to what others roles are and expectationes. so they can find a line and path forward. what i will commit to you, i'm not familiar with funding streams associated with that but i will certainly take a look at it, given that

that's the face of tsa, but the other side of tsa is preventing bad people and bad things from getting into the united states. can you talk about the threat of potential foreign fighters coming into the united states or the aviation threat that's currently out there? >> well, chairman, when i first took the job i, like most americans, my idea of what tsa did was they made me take my belt off at the airport. i have since learned it is unbelievably deeper and broader than that. world class laboratory as they test threats against aviation, literally blow up airplanes and collect the data as to what's within the realm of the possibility in terms of some of the threats we've seen, explosive threats we've seen. their ability to track individuals in a number of databases as they move around the globe, in many cases some of them might be in one of our databases, that buy a ticket from london to fly to the philippines, not even come into the united states. we see that, tsa sees that and we can use that information to warn our partners, not to mention individuals trying to buy a ticket or transp

but tsa should be the ones making the case.e public rule making and establish in a written record that this is a good security measure. they have been able to do just about anything they want from way back from the strip search machines. they are talking about people coming in from europe. this is a trial balloon to see if they can get a look at our books. kennedy: is this a violation of the first amendment? >> the whole thing is unless they can show it's truly justified, a reasonable search of our persons and papers, i don't think that's well made. it has been challenged in one court. so the ruling wasn't good. this needs to be unpacked. years and years after the 9/11 attacks we still have courts deferring to the tsa and it's not working for the american traveler. kennedy: what is the solution? we talked about privatizing airport security. what do you think the ultimate execution is? >> restoring responsibility for security to the airlines and the airports is the right way to go. in the meantime if a federal agency is going to

tsa is still relative to aviation safety. so the point is that the aviation threat is very very very real. i came over and briefed congress while i was doing it in mid-march. i put a number of final puts of departure i put them on a list where we did not want anything bigger than an iphone to travel in the passenger compartment. the threat was real, immediate and we reacted to it. since then we have engaged any number -- first of all, the aircraft industry as well as tsa counterparts around the world. we have come up with a plan to raise it to a much higher level. i have sent experts to interact with the eu. i'll send more are to brussels. we, the united states, department of homeland skurd, are drooifg this effort. i know routine aviation will be raised to a much higher level. we have kind of a step-by-step process. some things we can do in the next couple of weeks and then maybe a year and then it would be as new technology comes on is commercially available. we'll require individuals to do that as well. the bar will be rai
