jonathan turley, lee expected this appeal.cert for the supreme court right in front of me. they say section three of the 14th amendment is not self-executing and that president trump, as a president, does not fall into the text of this amendment. what do you think? >> it's a very strong appeal. it's frankly the moment many of us have been waiting for. for months, this dangerous theory has been replicated throughout the country as challengers try to find a judge or a court that will give credence to this theory. many of us believe it is fundamentally wrong, from a historical and legal persp perspective. they found some justices who are willing to do this. that court had seven democratically appointed justices and three of them refused to sign on with this and said it was clearly wrong. they were able to eke out a 4-3 win in colorado. that's a known outlier. you have the michigan supreme court following other ports in refusing to disqualify the former president. so it is right for the supreme court to review. there's a conflict

. >> jonathan, turley, thank you for joining us professor turley. tease this out with us. because january this ballot has to be finalized. there's a january 4th date listed here. how does this play out? >> well, it puts that on a rocket docket for the supreme court. they have to get involved first of all because there's not much time to make a final decision and also have to get involved because this is dead wrong. i think they are dead wrong on the law. i just published a piece in georgetown for this theory. i think it's fundamentally flawed. both in terms of the language of the constitution and the history. what is striking kaylie about the opinion is there was a series of barriers in applying this provision to bar trump. they had to adopt the most swe sweeping interpretation on every single issue. the only opinion that's not sweeping is when they get to the first amendment and free speech, then they adopt a narrow interpretation. they suggest trump doesn't have free speech protections. in order to establish he was engaged in an insurrection, they go back to speeches in

also here jonathan turley, a constitutional law attorney and fox news contributor.s for joining us. we have more news on this today. the colorado case in particular. the colorado republican party has challenged its appeal to the supreme court. what do we expect from here and how fast could the supreme court take this up? does the supreme court take it up? >> well, it's a very good question. there is an exit ramp that not only colorado might prefer, but the court itself might prefer. colorado's secretary of state agreed that trump will stay on the ballot if the supreme court does not rule before the january 5th certification date for the state. so what -- the position of the state is, unless the court agrees with the supreme court of colorado, which is extremely unlikely or declines any review, which is also unlikely, that trump will remain on the ballot. there won't be any action. what happens after that then becomes rather interesting. because colorado could move and say, look, this is now moot. there's no change on the ballot. people are going to be allowed to vot

jonathan turley, what's your thought on what is hang in maine? >> well, some of us had stated earlier we thought maine would go the way of colorado. i said that just today in a column of why these challengers went to maine. bellows wrote right after january 6th that it was an insurrection and kept on with those criticisms for the whole period after that. so she was on the record as saying donald trump in fact did engage in an insurrection. so this was one of those challenges where the answer seemed clear. you have got to keep in mind this is the secretary of state of maine. this is not a court. and many of these challenges in states like colorado were brought by democratic or approved by democratic secretaries of state. they then have to face judicial scrutiny. i am hoping that the court system in maine has the same integrity as many other states and rejects this theory. it is really striking how bell lois cloaks herself as a defender of democracy in this statement when she is preventing voters from casting their vote leading candidate for the pr

here is jonathan turley law professor at g.w. university. jonathan, to think that four up elected state court judges could conceivably end up determining the presidential election something that most americans shaking their head tonight saying this can't be the united states barriers to get to where it ended up. it adopted the most sweeping, broadest, possible interpretation to get over every one of those hurdles. so, throughout this opinion. it had to adopt interpretations that could encompass a wide array of statements. they use what is called true threat precedent to show that you can view what trump said as encouraging an insurrection by looking at stuff that he said at other times. and that, of course, allowed them to reach this conclusion. in my view the court is dead wrong. this is the first major win for these challengers, they have gone to a number of blue states. this is one of the bluest state supreme court can you get to even with that, i think the opinion is really chilling. i think that the supreme court will make fast work of

that from jonathan turley writing that op-ed. what do you think is the next step here?s obviously can still be appealed once the loser in the appeals case will go to the high court once that happens. but is this just the former president running out the clock? >> certainly a legal strategy and typically litigants do that. i would say the march 4th date that is currently on the calendar to hear the case in the d.c. court regarding whether or not the president interfered in the election process, that's march 4th, that's looking less and less likely to happen. the d.c. federal appeals court hears this in early january. let's say the former president loses and he appeals to the supreme court, and they may or may not take it up as we all know the supreme court has full discretion what they even take up and they take up less than 1% of the petitions that are presented before them every year. so it's unclear what they will even do. but i want to touch on something professor turley put in his column. i couldn't agree more. there is a lot of focus on jack smith and his team tryi

let's bring in jonathan turley. george washington university law professor.egin with. from when you hear about these deliberations and other failed attempts, does this make you feel confident that donald trump will beat this? >> well, i have never, as you have noted, had faith in this theory. i think that it's unfounded. both constitutionally and historically. it's also, perhaps, the most dangerous legal theory to come up in years. what you are suggesting is that the 14th amendment, in section 3 within that amendment, can block a candidate like trump from the presidential ballot. just on the vote of these judges. they are treating january 6th as an insurrection. something that trump has never been charged with he has never even charged with incitement. and, yet, this effort is going forward. and many of the advocates are going to blue states and colorado is really the hail mary throw. you had a lower court judge, judge wallace who was very critical of trump. but made fast work of this theory. and tossed it out. they are now going to, as favorable a state supr
