procedural motion and the special master standoff, the bigger story might be what lurks behind it and ty cobb just alluded to it. what do you think of his analysis of how broad this probe may be? >> i'm not certain that i agree with mr. cobb's assessment of the search warrant. he views it as being very broad and authorizing the government to take lots of documents. i think that this is a pretty standard sort of a search warrant when, after all, one of your criminal bases for the search warrant is the espionage act. this is to seize any evidence or fruits of crime. that's the standard language that's used. when you're talking about documents and trying to prove who was in possession of them, it's pretty routine to have the ability to take other items that are stored with the documents or that are mingled because you can use that to prove identity. but to cobb's larger point that trump has committed greater sins than this, i think something that's getting a little bit lost as we talk about the procedure is that the reality here is a former president has taken classified documents, including som

harry, do you agree with ty cobb? >> yeah, interestingly, ty cobb is saying that the indictment will likely go from emerge from january 6th. we have been generally sort of separating them out and people have been focusing on whether the documents themselves would lead to an indictment. but certainly, nothing he said today, you put your finger right on the filing where he said, well, the government says they're classified. but how do we know what that means? of course, that's what it means, to classify something, the government says. or i have this power to declassify, as you say, it screams the question, well, did you or didn't you? the judge is supposed to decide this by thursday and has not, as yet, called for a hearing, which would be a pretty obvious step to do so you can just ask the lawyers who obviously do, as you say, want to avoid criminal liability. well, did he or didn't he? how about telling us? as of now, though, it's on the papers and he's disputed everything, making -- giving her no easy out. she's goin

i want to go to former trump white house lawyer ty cobb. so let me start with something that we learned here about what's in the documents, as we pointed out, hundreds of pages, many boxes of documents. we now know one of the documents according to "the washington post" describes a foreign government's nuclear capabilities. do you think the doj has enough evidence at this point, putting aside all of this business with a special master, just from the evidence you have seen, do they have enough to indict the former president at this point? >> thank you, erin. nice to be with you again. i'm not sure that they do have enough to indict. and with regard to the document as described, you know, obviously if that's in fact true, it's a very serious manner. on the other hand, there will be a lot of questions with regard to that document. you know, was it previously unclassified? who had access to it? et cetera, et cetera. obviously, if it is as described, trump has no business having that document at mar-a-lago, and that does pose, you know, a distin

type of, trump's former attorney during the mueller investigation, i want to say more about what ty cobba desperate fashion. the search warrant is unusually large. >> and bra. >> broad. >> it's very very comprehensive in terms of, you know the types of documents that the government could take. >> earlier this week bill barr said the doj is getting closer and closer and now we hear from tight cop. what do you think about that, mark? >> i think they're right, especially when it comes to the mar-a-lago documents. the january 6th investigation has a lot of tentacles and i think it will take a long time for the justice department to get their arms around all of what happened there. it involves members of congress. it involves people in states all over the country. that can take a lengthy amount of time. but mar-a-lago documents, really, are much more finite case. the number of witnesses is-limited. you know, he took them, and he didn't give them back. so pretty simple case, and easy to understand. one reason that i agree, charges seem likely in that case is the presence of aggravating factors
