one uber driver is behind bars accused of sexual assault of one of his passengers.at this video. his name is rudolph and he's 59 years old driving a marine kia ultima. police say he picked up the victim when she used the uber app to get a ride to her palo alto home. she called for an uber pool which allows you to share your ride with other passengers but asked her to sit in the front but he never picked up those other passengers. he canceled the rides with them and when they arrived at her home he locked the doors started touching the victim's leg and kissing her and asked her to come into her apartment with her and she refused when he let her go. he's a red wood city based driver and police are not releasing his photo because they are trying to find out if there are more victims out there. we do have a call out to uber for comment on this situation and investigation but we have not gotten a response from them yet. i'll be here in palo alto throughout the morning with updates. >> avery harper reporting live from palo alto. now to the latest on decision 2016 the scor

can uber overcome these odds in china?it is a significant move great it's interesting to see dan loeb jumping and where apple has gone before. uber is far behind in the china market. was formed from the consolidation of the two largest players at the time. they have very high market share, both in the taxi market and the private car market. it's a brutal battle of competition. both companies spending billions of dollars in subsidies to draw in drivers and riders. one of the key things in this legislation is the government is saying you are not going to be able to charge less for a ride than what it costs. it's not clear how that will be interpreted great maybe those subsidies come down a bit and i will change the playing field in significant ways. emily: i'm taking a look at the headlines here. what are the highlights to you? >> well, the company missed both on revenue and on earnings. it's a challenge for the company. they have been described many times as the google of china. the issue for them is they have not been able
