and/or unbounded. let me go through those five uns because, i believe, that although some of them had aspects that were sound criticisms at various points in the prior versions, now they are either untrue or misleading, and that to continue to oppose the military commissions that i've summarized and described after two different administrations in the executive branch, the supreme court in the rumsfeld case which invalidated the 2001 version of commissions made very clear that congress had the ability to make commissions, and then no less than five acts of congress have established a strong basis for these commissions to continue to oppose them when considering how justice delayed at some point really does become justice denied, to continue to oppose that framework of the rule of law at this point is my final un, unwise. let me go back to unsettled, unfair, unnecessary, unknown, unbounded. okay. the argument that military commissions are unsettled is that you have to make this stuff up as you go along,

there was something of the old ratko mladic in court today -- proud and unbound. heat seemed -- he did not speak, but he listened, focusing closely throughout. mladic led the bosnian serb army as it drove hundreds of thousands from their homes. thousands were murdered. >> they were loaded in groups of five into a bus. the bus was driven to a field and as the men were forced off the bus, they could see the bodies of those before them. they were murdered as they left the bus. >> the prosecution described a carefully planned criminal enterprise, well-orchestrated, centrally directed, and state- sponsored. ratko mladic was at its head. the prosecutor said he was also responsible for the siege of sarajevo. snipers kept the people in a state of permanent terror. the shelling was indiscriminate. the court had a recording from 1994 of mladic boasting -- whenever i come to sarajevo, i kick the out of the turks. at this point, he appeared to suppress a laugh. but there was no playing to the gallery this time, no disruptions. we can expect, when it comes, a vigorous defense

files from a criminal case, to sit down for an interrogation, all under the authority of an alleged, unbounded city attorney right to investigate. now, the charter provisions that i have looked at indicate that if there is an alleged violation of the san francisco campaign and governmental conduct could, a complaint may be made to this commission, and it is this commission that decides to initiate the investigation, and the city attorney may participate in that investigation. i do not see anything in the charter or any other statutes that permit the city attorney to go out and start their own investigation. we need clarification on that issue immediately and urgently, because it seems to us that we would be fighting with one hand tied behind our back if they can go out and prepare whatever they need to prepare to proceed with this proceeding before you all have even promulgated rules of procedure that will hopefully proceed in an orderly fashion. now, i did want to address one point that mr. keith may. we do not intend to argue that these proceedings need to be private. indeed, we think they s

don't want it to be unbounded, don't want to turn soldiers into our civilian court system, but if given that mission, that we ought to be able to do it. so it's an institution on the books. we are developing a specialized practice you know, where we're able to handle large axts classified information safely. we have the clearances, we have is the departmental facilities. the defense counsel have those. we have the ability both to do justice and to protect information. beat develop relationships with agencies and organizations all over the government, increasingly with international partners. that specialized practice is an -- as an institution is a valuable thing to keep going. not just by its own momentum, but you can see if there is a need for it to keep that going. and that even though the number of cases may be small, the -- the national interests vindicated could be hugely important, justifying the expense involved in that. so you know, congress has invested a lot of legislative effort in trying to pull this together in a way that's consistent with our values and that does justice.
