in many cases, they do not even pay their fair share of taxes. but under citizens unitednlimited corporate spending on elections is now treated as a free speech and is protected under the first amendment of deeper -- of the constitution to do with this decision, the supreme court and our national democracy is in crisis. the supreme court got it wrong when the world that unlimited spending on political campaigns is a form of free speech. by striking down sensible limits on campaign spending, the court has allowed the voices of a few wealthy interests to speak louder than the rest of us. is it any wonder that the people to like government does not listen to them anymore? since the ruling, corporations have been legally allowed to spend unlimited amounts of money in our elections on behalf of federal candidates. many of these contributions are made in secret. with no telling who is paying for the so-called social welfare organizations which front corporate political donors. the citizens united ruling has green lighted unprecedented campaign spending in the rise of super pacs

for instance, i'm sure you're all familiar with the citizens united case. so you can debate the merits of that case one way or the other, but it's an indication that this court takes a view of the first amendment that i think has strayed rather far from certainly what the framers would have seen as the dimensions of the first amendment. for instance, this is a case that i think is heading to the court now about whether the government has the power to order cigarette makers to put very graphic warning labels on the packaging, and a federal district judge -- i think not necessarily incorrectly interpreting where the supreme court is going -- said that this requirement was a violation of the first amendment rights of the cigarette makers because it was a form of compelled speech. so that's pretty interesting. you know, we have a regulated product. congress has given the government, the food and drug administration the right to regulate aspects of cigarette marketing. and congress determined that this was an appropriate deterrence to smoking and so on. and how t

kennedy was dismissive of the caperton decision in the citizens united case. i do not see any light at the end of the tunnel. dore supposed to go out and it the way that was supposed to play out. some of the issues we are talking about, pro consumer and pro corporate do not sit in what might be the current democrat /republican split in ideology. this is more of a populist to corporatist or pro-a citizen obverses pro powerful. i come from virginia, you are from mississippi on this. to some people, it has been a surprise to see montana, which is not seen a left-wing state really leading to a judicial push back on this. in your sense, what are the lines being drawn here? is it one that is about different ideology on the court? or is it purely a matter of a follower of money? >> on the supreme court? >> also trickling into the state elections. in other words, when you see the montana supreme court having a fairly forcible push back on this, why do see that coming from a state like montana as opposed to something you might see is a more traditionally liberal state.

welcome back everybody, two years ago, the supreme court handed down its decision on the citizen's united caseunions to pour millions upon millions into political campaigns. yesterday in a read it on line chat, the president suggested he would support presidential action to undo the court's ruling. the president wrote "over the longer term i think we seriously need to consider mobilizing the constitutional amendment, assuming the supreme court doesn't revisit it, even in the amendment process falls short it can shine a spotlight and help to apply pressure for change." now the gop opposes any law that would weaken citizens united. super pacs are playing a big role in this cycle. more than 230 million have been spent by outside groups made possible by citizens united. a majority of that money, about $200 million has been spent to support mitt romney. so what do you think? should there are a constitutional amendment to overturn citizen's united? that will do it for this edition. don't go anywhere. the cycle comes your way next. it's time to live wider awake. only the beautyrest recharge sleep sys
